Alternative punishments in the Czech judiciary and the execution

Abstract:

Diplomová práce se zabývá alternativními tresty v České justici a jejich zajištění. Teoretická část se zabývá pojetím trestu, jeho významu a dopadům. Samostatná kapitola je věnována Vězeňské službě ČR, pro porovnání uvádím také typy věznic na Slovensku a v Polsku. V další kapitole jsou popsány jednotlivé alternativní tresty. Konkrétně pak domácí vězení, obecně prospěšné práce, propadnutí majetku, peněžitý trest, propadnutí věci, nebo jiné majetkové hodnoty, zákaz činnosti, zákaz pobytu, zákaz vstupu na sportovní, kulturní a jiné společenské akce, ztráta čestných titulů a vyznamenání, ztráta vojenské hodnosti, vyhoštění, podmíněný odklad výkonu trestu odnětí svobody a podmíněný odklad výkonu trestu odnětí svobody s dohledem. Poslední kapitola teoretické části pak popisuje činnosti a význam Probační a mediační služby v ČR s ohledem zajištění alternativních trestů. V praktické části své práce jsem využila výzkumný projekt a zvolila jsem kvantitativní a kvalitativní výzkum. Cílem praktické části je podat ucelené informace o četnosti ukládání alternativních trestů v České justici. Dále byly provedeny rozhovory se subjekty v trestní justici, konkrétně s úřednicí Probační a mediační služby, bývalým policistou, pracovníkem vězeňské služby a aktivním policistou. V druhém typu rozhovoru jsou mými informanty samotní odsouzení k alternativnímu trestu. V rozhovorech jsem se zajímala zejména o to, jak jsou alternativní tresty vnímány, zda jsou alternativní tresty vhodnější, než uložení trestu odnětí svobody, jaké jsou negativa alternativních trestů a komu by měly být tyto tresty ukládány. U samotných odsouzených mě zajímalo, o jaký trest se jedná, zda se jedná o prvotrestané osoby či recidivisty a jak oni vnímají uložení alternativního trestu s ohledem na zachování rodinných a profesních vztahů.

Abstract:

This thesis deals with alternative punishments in the Czech judiciary and their execution. The theoretical part deals with the concept of punishment, its meaning and implications. A separate chapter is devoted to the Prison Service of the Czech Republic, I mention the types of prisons in the Slovak Republic and Poland for comparing. The next chapter describes various alternative punishments. Specifically, house arrest, community service, forfeiture, fines, confiscation of the property or other assets, prohibition of activities, residence ban, ban on attending sports, cultural and other social events, loss of honorary titles and awards, loss of military rank, expulsion, suspended penalty of imprisonment and a suspended penalty of imprisonment with supervision. The last chapter describes the activities and the importance of the Probation and Mediation Service in the Czech Republic with regard to providing alternative punishments. In the practical part I used a research project and I chose quantitative and qualitative research. The practical part is to provide integrate information on the frequency of alternative sanctions in the Czech judiciary. I also carried out interviews with subjects in the criminal justice, specifically with Probation and mediation service officer, former policeman, prison staff and an active police officer. In the second type of interview the informants are the persons sentenced to an alternative punishment. In the interviews I was particularly interested in how the alternative punishments are perceived, if the alternative punishments are more appropriate than imprisonment, what are the cons of alternative punishments and who is supposed to be punished by such an alternative punishment. Concerning the very convicts I was interested what kind of the punishment they have, whether a person is a convict for the first time or recidivist and how they perceive the imposition of an alternative punishment with a respect to preserving family and professional relationships.
