Housing co-ownership of the new Civil Code

Abstract:

Předmětem bakalářské práce Bytové spoluvlastnictví podle nového občanského zákoníku je identifikace rozdílů mezi stávající právní úpravou bytového spoluvlastnictví obsaženou zejména v zákoně č. 72/1994 Sb. o vlastnictví bytů, ve znění pozdějších předpisů, vyhlášce č. 371/2004 Sb. (vzorové stanovy) a novou právní úpravou, kterou obsahuje zákon č. 89/2012 Sb. občanský zákoník. První část je zaměřena na srovnání stavu bytového vlastnictví a spoluvlastnictví dle původní a nové právní úpravy. Druhá část je věnována daňové a účetní problematice bytového vlastnictví a spoluvlastnictví. Poslední část se zabývá dopadem nové právní úpravy na konkrétní právnickou osobu.

Abstract:

The subject of the Bachelor thesis Housing co-ownership under the new civil code is the identification of differences between the existing legislation contained in particular in the joint ownership of the Housing Act No. 72/1994 Coll. on ownership of the flats, as amended, Decree No. 371/2004 Coll. (sample bylaws), and the new legislation, which includes the law No 89/2012 Coll. Civil Code. The first part is focused on a comparison of the status of the apartment ownership and co-ownership from the original and the new legislation. The second part is devoted to tax and accounting issues of housing ownership and co-ownership. The last part deals with the impact of the new legislation on a specific legal person.
