The so-called Assisted Contact betwen the Parents and the Minor Child

Abstract:

Diplomová práce se věnuje aktuálnímu tématu asistovaných kontaktů rodičů s nezletilými dětmi, zejména z pohledu rodinného práva. Jádrem práce je analýza životních situací, kdy k využití asistovaných styků dochází, včetně řešení kolizí práv zúčastněných osob, jakož i srovnání staré a nové právní úpravy s úvahami de lege ferenda. Problematika je řešena s využitím odborné literatury, legislativy, judikatury i praxe. Přínos práce spočívá v poskytnutí komplexních informací ohledně realizace asistovaných styků z pohledu rodinného práva, čemuž se současná odborná literatura doposud příliš nevěnovala.

Abstract:

The diploma thesis deals with the current topic of the assisted contact between the parents and the minor children, particularly from the perspective of family law. The core of the work is to analyze situations when assisted contact is used including solving of conflicts of interests, and comparison of the old and the new legislation, with considerations de lege ferenda. The problem is solved with the help of literature, laws, ruling and practice. Contribution of the work is providing information on assisted contacts from the perspective of family law, which is the current literature yet highly developed.
