Administrative Delicts in the Light of Judicature of the Administrative Court

Abstract:

Anotace Předkládaná bakalářská práce „Správní delikty ve světle judikatury Nejvyššího správního soudu“ je rozdělena do tří na sebe navazujících kapitol. Správní delikty jsou právním pojmem, do kterého lze (vedle správně pořádkových a správně disciplinárních deliktů) zařadit zejména přestupky a jiné správní delikty. Jiné správní delikty se dále vnitřně člení na „jiné správní delikty fyzických osob“, „jiné správní delikty právnických osob“ a „jiné správní delikty podnikajících osob“. V oblasti přestupků je jejich obecná část upravena zákonem č. 200/1990 Sb., přestupkový zákon. Tento zákon obsahuje rovněž řadu specifických procesních ustanovení. V případě jiných správních deliktů avšak, není obecná část upravena souborně v žádném právním předpise a procesně se řídí podle správního řádu. A právě z důvodu chybějící legislativní úpravy je rozhodovací činnost NSS v oblasti správních deliktů velmi důležitá. NSS jakoby „dotváří“ chybějící části právní úpravy správních deliktů, ač judikatura soudů není v českém právu pramenem práva.

Abstract:

Annotation The tabled BA Thesis called „The Administrative Delicts in Light of Judicial Decisions of the Supreme Administrative Court of the Czech republic” is divided into three coherent chapters. The legal term „an administrative delict“ is a cover legal term under which is possible to subsume especially the delicts according the Act Nr. 200/1990 Coll., on administrative infraction, on one hand, and the group of „other administrative delicts“ according other Czech Acts on the other hand. The group of „other administrative delicts“ is further internal divided into „other administrative delicts of the natural persons“, „other administrative delicts of the corporations“ and „other administrative delicts of the entrepreneurs“. In the field of delicts according the Act Nr. 200/1990 Coll., are within this Act set down as well the general as the special provisions. This Act contents many specific procedural provisions too. In the field of the „other administrative delicts“there is neither the general nor the systematically set down special part in any of the Czech laws. The administrative trial proceeds according to the Act Nr. 500/2004 Coll., Code of administrative procedure. Because of the lack of legislation in the field of “other administrative delicts” is the decision making of The Supreme Administrative Court of the Czech Republic (further “SAC”) of a great importance. SAC “quasi” creates the missing part of legislation in the issue of the administrative delicts, although the judicial decisions are not one of the sources of law within the Czech Republic.
