Abstract:
Disertační práce se zabývá koncepcemi a principy převodu vlastnického práva v evropském kontextu. Přináší teoretické rozpracování principu kauzální a abstraktní tradice a konsenzuálního principu. Zabývá se rovněž oddělením obligačních a věcných úkonů a teoretickému pojetí věcné smlouvy. Výsledky práce jsou podrobeny srovnání s úpravou v knize VIII DCFR, kde se uplatňuje princip kauzální tradice. Práce …more
Abstract:
The thesis deals with concepts and principles of the transfer of ownership in the European context. It brings theoretical elaboration of abstract and causal tradition and consensual principle. It also discusses the justification and theoretical concept of the real agreement as a separate contract which content is an agreement to actually dispose the ownership.
