Management and Debt Collection in the Town of Podbořany

Abstract:

Tato bakalářská práce je zaměřena na správu a postupy při vymáhání pohledávek Města Podbořany, které stejně jako stovky ostatních měst a obcí řeší otázku pohledávek a letitých neplatičů. Jako zaměstnance veřejné správy, který se problematikou pohledávek zabývá, mne zajímá, zda mám k dispozici dostatek pravomocí, které lze pro vymáhání pohledávek uplatnit a zda jsou tyto pravomoci dostatečné pro vymožení pohledávky. Je vymáhání pohledávek úředníky měst a obcí efektivní? Má jejich práce smysl? Jaká je úspěšnost vymáhání? Objasnění těchto otázek je cílem mé práce, stejně jako potvrzení nebo vyvrácení nastupujícího trendu, kdy města a obce přestávají vymáhat pohledávky a raději je předávají exekutorskému úřadu. V teoretické části popisuji základní strukturu pohledávek, rozdělení a postup před předáním pohledávek k vymáhání. V praktické části se zabývám konkrétními postupy se zaměřením na jednotlivé druhy vymáhání, kterými jsou daňová exekuce, soudní vymáhání a vymáhání exekutorem a na úspěšnost vymáhání.

Abstract:

This Bachelor´s thesis presents the overview of producers in debt collection in the town of Podbořany, as well as hundreds of other cities and municipalities. It resolves the issue of debts and the old-age dodgers. As an enployee in public servises, I´m interested in how to recover debts, which competences I have for it and if they are sufficient. Is debt collection efficient? Is it meaningful? How much sufficient is it? The main aim of this thesis is to answer these question as well as pursit of negation or confirmation nowadays trend accorging to which towns transfer their debts to executors rather than collect them themselves. The teoretical part describes basic structure, distribution and procedure before passing to the recovery of debts. The practical part deals with specific practices with the focus on individual types of recovery, such as the tax court distraint, enforcement and the recovery of exekutor and the success of the recovery.
