The Alternative Sentence

Abstract:

Bakalářská práce se zabývá alternativními tresty užívanými v České republice. Cílem bakalářské práce bylo zjistit, jaký je postoj a povědomost veřejnosti v okrese Česká Lípa o užití a ukládání alternativních trestů a nepodmíněného trestu odnětí svobody. Práce je rozdělena na dvě části, teoretickou a praktickou. Teoretická část definuje základní pojmosloví, tedy pojem trest, užití trestu, jeho účel a historii trestu a trestání. Dále se teoretická část podrobně věnuje výčtu a popisu alternativních trestů užívaných v české právní úpravě. Praktická část je zpracována na základě metody nestandardizovaného dotazník a 3 předpokladů k budoucím výsledkům dotazníkového šetření. Praktická část odpovídá na otázku jaký je postoj a povědomost veřejnosti v okrese Česká Lípa o užití a ukládání alternativních trestů a nepodmíněného trestu odnětí svobody a zda vyslovené předpoklady byly naplněny. Dále jsou zde prezentována jednotlivá konkrétní navrhovaná řešení ke zlepšení postoje veřejnosti k alternativním trestům v České republice.

Abstract:

This thesis deals with alternative sentences used in the Czech Republic. The aim of this thesis was to find out about the public attitude and awareness in the district of Czech Lipa about the usage of the alternative sanctions and imprisonment. The work is divided into two parts, theoretical and practical. The theoretical part defines the basic terminology, a concept of sentence, the use of sentence, its purpose and history of sentence and punishment itself. Furthermore, the theoretical part is looking into the detail in the enumeration and description of the alternative sentences used in the Czech legislation. The practical part is based on a method of nonstandardized questionnaire and 3 assumptions for future survey results. Practical part answers the question about the public attitude and awareness in the district of Czech Lipa and usage of alternative sanctions and imprisonment, and whether expressed assumptions were met. This section describes each specific proposed solutions to improve public attitudes to alternative sentences in the Czech Republic.
