Abstract:

Tato práce se zabývá ukládáním a výkonem ochranného léčení. Cílem práce bylo najít historické kořeny ochranného léčení, trestně prvání úprava a postupu OČRT při ukládání ochranného léčení. Základem pro uložení ochranného léčení je zejména příčetnost či nepříčetnost pachatele při nezbytnosti vypracování znaleckého posudku z oboru psychiatrie. Ochranné léčení může být uloženo ve formě ústavní či ambulantní, přičemž samotný výkon ochranného léčení lze vykonat vedle trestu, před trestem nebo po trestu odnětí svobody. Další varianta je vykonání ochranného léčení bez restu,v případě, že pachatel je nepříčetný. Následuje komaparace naší právní úpravy ochranného léčení s právní úpravou Slovenské republiky. Již v průběhu práce je poukazováno na problémy, které se vyskytují s ochranným léčením, zkráceně je toto popsáno v závěru práce.

Abstract:

SUMMARY Sentencing and execution compulsory treatment Institute protective treatment includes in particular protection of society against offenders who commit crimes and their punishment itself imprisonment is not sufficient to guarantee their own remedy. At the same time the Institute also includes preventive effect on offenders who commit crimes because of their mental illness and at the time of committing crime are deranged. The principle of the protective treatment is a possibility to return the offender back into society and learn to control your ailment before committing further criminal activity. Protective treatment is regulated in the basic limits of the Constitution and the Charter of Fundamental Rights and Freedoms, and then more detailed treatment in the criminal law of the CR. Save the protective treatment can be applied only to court and to the extent that the legal order of the Czech Republic. Another option to save there. Compulsory treatment can be stored in the form of constitutional or as an outpatient. The amendment to the Criminal Code, which is effective from 1 1st 2009, the recodification of the Penal Code No. 140/1961 Coll., And this amendment meant a great importance for offenders who were sentenced to protective treatment, since under the new legislation, the court must review every two years, justification of protective treatment. This ensures objectivity and storage of protective treatment and greater rights for the perpetrators. Also newly introduced security detention institutions, which in some points related to the protective treatment, while there are noticeable differences. One of the biggest differences is itself a crime, while the protective treatment is practically imposed for any crime, security detention can be imposed only for particularly serious offense. The new draft Penal Code currently in this area lie in security detention arrangements, which will be able to save as well as protective treatment for any offense, of course, under the conditions provided for by law. Next steps which should contribute to the objectification of protective treatment, not only is cooperation between the courts and medical facilities, but also police, which has far greater capabilities and an overview of crime committed and therefore the findings of offenders, who have a protective treatment. Interesting is the comparison of our criminal legislation with legislation of the Slovak Republic, which was once an integral part of history. Finally, the whole work is that the protective treatment makes sense and protects society from the offender. Protective treatment as a solution to help companies and individuals as well as himself, although in some cases involuntarily imposed on individuals who violated the law. It should be a greater penetration into in case of breach of protective treatment, because this can lead to far more serious offenses than those for non-risk protective treatment..
