Current initiatives seeking higher protection of personal data of social networks users

Abstract:

Tato magisterská diplomová práce se zaměřuje na problematiku ochrany dat a soukromí v prostředí sociálních sítí. Teoretická část se zabývá pojmem soukromí, jeho chápáním v různých kulturách a jurisdikcích a nastiňuje vývoj pojmu soukromí v digitálním věku. Podrobněji je zpracována problematika soukromí v sociálních sítích. Z kontextu daného teoretickou částí diplomové práce vychází část praktická, jejímž cílem je představit a porovnat současné evropské iniciativy, které tlakem na změnu legislativy nebo na lepší vymahatelnost platných zákonů usilují o zajištění vyšší úrovně ochrany soukromí a osobních dat uživatelů sociálních sítí. Pro srovnávací analýzu cílů, metod a možných dopadů činnosti na uživatele a provozovatele sociálních sítí byly vybrány čtyři iniciativy zahrnující aktivity Evropské komise a Rady Evropy na poli reforem stávající legislativy a aktivity evropských nevládních organizací Europe vs. Facebook a EDRi, jejichž cílem je prosazování práva na soukromí, ať již v rámci stávajícího legislativního rámce nebo prostřednictvím návrhů na jeho změny.

Abstract:

This master’s thesis focuses on data protection and privacy in social networks. The theoretical part deals with the concept of privacy, its understanding in various cultures and jurisdictions, and outlines the development of the concept of privacy in the digital age. The issue of privacy in social networks is treated in detail. Based on the context established in the theoretical part, the practical part of the thesis is aimed at presenting and comparing the current European initiatives seeking to secure a higher level of protection of social networks users’ privacy and personal data. Four initiatives were chosen for a comparative analysis of targets, methods and possible ramifications of their activities on social networks operators and users, including activities of the European Commission and the Council of Europe concerning reforms of the current legislation and the activities of European NGOs Europe vs. Facebook and EDRi aimed at promoting the right for privacy within the current legislation framework and by proposing its changes, respectively.
