Capital Markets Regulation and Surveillance within the Globalization Era

Abstract:

Ve všech vyspělých zemích finanční sektor prochází neustálými změnami. Tyto změny způsobuje mnoho faktorů jako je globalizace, snaha harmonizovat právní normy, zvyšování konkurenceschopnosti, odstraňování institucionálních bariér atd. Tyto faktory mění reálný finanční svět a činí jej dynamičtějším a spolu s tím i rizikovějším. Regulace a dohled musí proto reagovat na reálný vývoj finančního sektoru. Nositeli dohledu nad finančním trhem jsou ve vyspělých státech různé orgány a instituce, které používají nejen odlišný stupeň samostatnosti, ale jsou také různým způsobem financovány. Teorie finanční regulace dosud nepřinesla výraznější a průkaznější vědeckovýzkumné důkazy, které by umožnily vytvoření ideálního modelu institucionálního uspořádání finančního dohledu. Česká republika se také zapojila do integračního procesu. Dohled nad finančním trhem provádí v současné době Česká národní banka. Snaha České národní banky, je podle mého názoru, dosáhnout úplné implementace legislativních norem evropských směrnic ( např. MiFID) do legislativního prostředí České republiky.

Abstract:

The increasing pace of evolution of financial market in all developed countries is caused by many elements as globalization, the need to harmonise law framework of EU member states, some changes might be adopted to make the financial market more efficient and free of institutional obstacles. This fast evolving financial sector also bares more risk and therefore regulations as well as financial supervision need to respond effectively to those shifts. In addition the vehicle institutions undertaking supervision of financial market vary as differs the way these organizations are financed from country to country since the regulation of the financial market has not advanced enough to create an ideal model of institutional structure in respect of financial supervision. In the Czech Republic which also joined the financial regulation and integration process is the supervision of financial sector carried out by the Czech national bank. This institution has in my opinion taken an initiative aimed at achieving a full implementation of European legislative rules and principles (etc. MiFID) to Czech legislation
