Selection of the legal form of business of a small entrepreneur in term of accounting and tax aspects

Abstract:

Předmětem diplomové práce „Výběr právní formy podnikání malého podnikatele z hlediska účetních a daňových aspektů“ je analýza právních forem podnikání vhodných pro malého podnikatele, a to se zaměřením na účetní aspekty, daňové zatížení a odvody na zdravotní a sociální pojištění. V první části je vymezen podnikatel jako fyzická osoba, kapitola je zaměřena na možnosti evidence účetních dat z hlediska daňové optimalizace. V druhé části jsou uvedena specifika přechodu živnosti na podnikání jako právnická osoba. Ve třetí části je podnikatel vymezen jako právnická osoba a jsou zde uvedeny možnosti daňové optimalizace jediného společníka s.r.o. V poslední části jsou pak teoretické poznatky aplikovány na situaci konkrétního podnikatele a je navržena vhodná právní forma podnikání.

Abstract:

The goal of the submitted thesis: “Selection of the legal form of business of a small entrepreneur in terms of accounting and tax aspects” is to analyze legal forms suitable for a small entrepreneur, focusing on accounting aspects, tax burden and payments of health insurance and social security. In the first part an entrepreneur as an individual is defined and the chapter is focused to possible ways of recording accounting data in terms of tax optimization. In the second part there are described specifics of transition of trade business in the business as a legal entity. In the third part an entrepreneur as a legal entity is defined and there are listed options of tax optimization of a sole shareholder of Ltd. In the last part theoretical knowledge is applied to a particular entrepreneur and there is suggested appropriate legal form of business.
