Analysis of the shared accommodation regulation methods in selected European capitals

Abstract:

Tato diplomová práce se věnuje problematice sdílené ekonomiky a jejích aktérů. V práci je analyzována právní povaha subjektů, které v rámci sdílené ekonomiky působí. Blíže jsou specifikovány výhody i nevýhody nových modelů spadajících pod sdílenou ekonomiku, včetně modelu sdíleného ubytování. Dále je práce zaměřena na právní postavení sdílené ekonomiky v rámci současné české legislativy a na chystané legislativní změny, které se dotknou platformy Airbnb a jejích uživatelů. Analytická část práce se věnuje aktuálnímu působení Airbnb v Praze a možnostem regulace sdíleného ubytování v tomto městě. Pomocí sekundárních zdrojů je provedena analýza řešení regulace v Berlíně, hlavním městě Spolkové republiky Německo, a v Amsterdamu, hlavním městě Holandska. Na základě metody komparace současného stavu působení Airbnb ve vybraných metropolích jsou navržena možná řešení regulace trhu sdíleného bydlení v Praze.

Abstract:

The thesis deals with the issue of shared economy, its main participants and the current legislation. The legal framework of the shared economy is analyzed, as well as the advantages and disadvantages of the new models of shared economy. The subject of shared accommodation model is examined in more detail, further exploring the legal position of the shared accommodation under the current Czech legislation and the forthcoming legislative changes that will affect the Airbnb platform and its users.The analytical part of the thesis deals with the current activities of Airbnb in Prague and the possibilities of regulation of shared accommodation in this city. Secondary sources are used to analyze regulatory solutions in two European capitals, in Berlin and in Amsterdam. Based on the method of comparing the current state of Airbnb's activities in selected capitals, possible solutions to the regulation of shared housing in Prague are proposed.
