The Right for Information in Relation to the Public Service of The Czech Republic

Abstract:

Ve své diplomové práci na téma "Právo na informace ve vztahu k veřejné správě ČR" se zabývám nejprve samotným pojmem informace, dále pak právem na informace, historickým vývojem u nás i ve světě, ústavněprávními základy v ČR. Dále se pak věnuji analýze především stěžejního zákona, a to zákona č. 106/1999 Sb., o svobodném přístupu k informacím. Dále pak o něco stručněji analyzuji zákon č. 123/1998 Sb., o právu na informace o životním prostředí a další související právní předpisy, jako např. zákon o ochraně utajovaných informací a bezpečností způsobilosti, zákon o informačních systémech veřejné správy atd. Samostatnou kapitolu věnuji svým poznatkům z praxe s uplatňováním práva na informace. V práci dále zmiňuji právní úpravu práva na informace v některých vybraných státech, např. USA, Velké Británie, Portugalska a některých nových členů Evropské unie. V závěrečné kapitole zmiňuji několik poznatků, ke kterým jsem ve své práci dospěla a navrhuji možné změny do budoucna.

Abstract:

The work is split in ten main chapters. The terms information and the right to information are explained in the third and forth chapter after the short introduction in the second chapter. Consequently historical evolution in the Czech Republic and foreign countries are explained. Chapter six describes constitutional-law fundamentals. The basic statute containing the right to information is the statute no. 106/1999 Sb., Free Access to Information remarked above is minutely explained in the seventh chapter. Next chapter continues with pieces of knowledge and experience associated with applying the statute no. 106/1999 Sb., Free Access to Information. Prototypal emails were sent to different mandatory subjects of law. The answers were checked. Some of subjects have not answered, some of them have asked for the reason of the requested piece of information and only few of them have really answered my request. The forenamed statute no. 123/1998 Sb., about the right to environmental information and another related status are given in the eighth and ninth chapter. The last part of this work is devoted the right to information in foreign countries, for example the United States of America, the United Kingdom, Portugal and chosen new members of the European Union, in the first place on the constitutional level.
