Tax evasion in Czech Republic

Abstract:

Diplomová práce se zabývá úmyslnými i neúmyslnými daňovými úniky u daně z příjmů právnických osob na území České republiky. Cílem práce je poukázat na problematiku daňových úniků a stanovit možná doporučení, jak eliminovat zejména neúmyslné daňové úniky u daně z příjmů právnických osob. Teoretická část práce vychází od základních pojmů daňového systému, přes charakteristiku a stanovení daně z příjmů právnických osob, až po vymezení samotných daňových úniků a daňové kontroly jako možného nástroje jejich odhalení. Práce popisuje příčiny, důsledky a návrhy eliminace daňových úniků. V textu jsou uvedeny vybrané podoby daňových úniků doplněné o praktické příklady vycházející z nálezů kontrolní činnosti finančních úřadů a soudní judikatury. V praktické části je popsána ukázka daňového úniku z praxe, jenž byl odhalen na základě proběhlé daňové kontroly u reálné společnosti, navíc je text obohacen o vybrané daňové statistiky.

Abstract:

The thesis is focused on intentional and unintentional tax evasions of corporate income taxes within the Czech republic. The aim of my thesis is refer to issue of tax evasion and arrange possible suggestions for the elimination of the unintentional tax evasion of corporate income tax. The theoretical part is patterned on the basic terms such as the tax system, characteristics and determination of corporate income taxis, specification of the tax evasions and the tax audit as the possible tool for the detection of the tax evasions. The thesis describes causes, consequences and suggestions for the elimination of the tax evasion. Selected types of tax evasions are presented in the text and they are supplemented by practical examples that are patterned on financial institution control procedures and court decisions. An example of real-life tax evasion, revealed on the basis of executed tax audit in an existing corporation is presented in the practical part of the thesis. Selected tax statistics are added to the text.
