Abstract:

Tato rigorózní práce zkoumá a komplexně pojednává o institutu nutné obhajoby. Je zaměřena zejména na kritické zhodnocení jeho účelu a šíře důvodů, pro které je dle současné platné a účinné právní úpravy obviněný povinen mít v trestním řízení obhájce. Problematika, která je prací řešena, a která prostupuje celým jejím textem, je zákonodárcem proklamované zúžení případů nutné obhajoby obviněných osob v trestním řízení v připravované rekodifikaci trestního práva procesního. Otázka, zda je de lege ferenda správné, aby došlo k moderaci důvodů nutné obhajoby či zda by měl být rozsah nutné obhajoby i v novém trestním řádu zachován, je řešena jak z pohledu zákonodárce, tak z pohledu obviněných osob. Práce obsahuje jednak rozbor pojmu nutné obhajoby a právních pramenů, které ji upravují, ale zejména pak detailně zkoumá a kriticky hodnotí jednotlivé důvody nutné obhajoby dle zákona č. 141/1961 Sb., o trestním řízení soudním (trestní řád) a legislativní změny učiněné zákonodárcem v této oblasti v minulých letech. V závěrečných kapitolách je zkoumáno postavení zvoleného či ustanoveného obhájce v trestním řízení a náklady spojené s institutem nutné obhajoby. Práce nabízí též úvahy de lege ferenda spojené s řešenou problematikou.

Abstract:

This thesis examines and complexly deals with the institute of mandatory defence. It is focused on critical evaluation of the purpose and the width of the cases for mandatory defence in a current Czech Code of Criminal Procedure. An issue that is discussed in this thesis and which permeates its whole content, is the proclamation of the legislator that the cases of mandatory defence will be reduced in the near future. The question whether it is right to moderate the width of cases for mandatory defence is examine from the perspective of the legislator and also from the perspective of the accused. The thesis contains an explanation of the terms of the institute of mandatory defence and analysis all acts that regulates the obligation to have a counsel in criminal proceeding. The crucial part of this thesis examines and critically values cases for mandatory defence according to Act. No. 141/1961 Sb., Code of Criminal Procedure and the legislative changes that has been made in recent years. The final chapters deals with the status of the chosen and appointed counsel and also analyses the costs of the mandatory defence. The thesis also contains de lege ferenda proposals with this issue.
