Legislation Financial Control in Public Administration

Abstract:

Autor se ve své diplomové práci věnuje právní úpravě prostředí finanční kontroly ve veřejné správě v České republice. Úvodem práce je představení základních pojmů a požadavků pro správné fungování finanční kontroly. Právní úpravě je nejprve rozebírána z hlediska jejího historického vývoje na území České republiky. Poté se zaměřuje především na koncepci finanční kontroly a zvláště interního auditu. Koncepci představuje ve světle zákona č. 320/2001 Sb., o finanční kontrole v platném znění. Ustanovení tohoto zákona porovnává s ustanoveními Mezinárodního rámce profesní praxe interního auditu. Podle názoru autora je stávající právní úprava interního auditu nevyhovující a nedostatečně odráží požadavky IPPF. Na závěr je provedeno porovnání současné právní úpravy a IPPF s novým návrhem zákona o řízení a kontrole veřejných financí. Cílem posledního porovnání je určit, zda návrh zákona přinese zlepšení fungování interního auditu.

Abstract:

In this diploma thesis author discusses the legal environment of financial control of public administration in the Czech Republic. On the beginning of this diploma thesis is an introduction of basic concepts and requirements for the proper functioning of financial control. Legal regulative is at first discussed from the perspective of its historic development in the Czech Republic. After that it focuses on the concept of financial control, especially on the internal audit. The conception is presented by the Act no. 320/2001 Coll., on financial control, as amended. The provisions of this Act compares with the provisions of International Professional Practices Framework. According to the author´s opinion is the existing legal regulation of internal audit inadequate and poorly reflects the requirements of IPPF. At the end is done the comparison of current law and IPPF with the new draft law of management and control in public financials. The aim of the last comparison is to determine, if the draft law can bring improvement of internal audit.
