U.S. foreign policy actors' positions towards the International Criminal Court

Abstract:

In 2002, the International Criminal Court (ICC) was created. ICC is the first criminal court of international nature which potentially has a universal jurisdiction ratione temporis and ratione loci. Success of the ICC in prosecuting international crimes depends especially on the ratification of its statute by individual states. One of the signatories of the Rome Statute is the USA, which till this day did not ratify it. As a result, the USA is not legally bound by the Rome Statute. In this thesis I address the reasons due to which the USA did not ratify the Rome statute and also the positions of individual actors of U. S. foreign policy towards the cooperation with ICC on the prosecution of the perpetrators of international crimes and the possible future ratification of the Rome Statute. Furthermore, the thesis deals with the question of to what extent is the U. S. policy towards ICC influenced by the party affiliation of the major actors. The thesis analyses the positions of individual actors with regard to their position in the specific branch of the government (executive, legislative and judiciary).

Abstract:

V roku 2002 došlo k vzniku Medzinárodného trestného súdu (ICC), prvého trestného súdu medzinárodnej povahy s potenciálne univerzálnou jurisdikciou ratione temporis a ratione loci. Úspech ICC v stíhaná medzinárodných zločinov však závisí najmä na ratifikácii jeho štatútu zo strany jednotlivých štátov. Jedným zo signatárskych štátov Rímskeho štatútu sú aj USA, ktoré ho avšak do dnešného dňa neratifikovali, čo má za následok právnu nezáväznosť Rímskeho štatútu pre USA. V tejto práci sa zaoberám dôvodmi, ktoré viedli USA k neratifikovaniu Rímskeho štatútu a najmä postojmi jednotlivých aktérov americkej zahraničnej politiky voči spolupráci s ICC na stíhaní páchateľov medzinárodných zločinov a prípadnej budúcej ratifikácii Rímskeho štatútu. Práca sa ďalej venuje otázke, nakoľko je americká politika v prípade ICC ovplyvnená straníckou príslušnosťou jej hlavných predstaviteľov. Práca analyzuje postoje jednotlivých aktérov s ohľadom na ich príslušnosť ku konkrétnej zložke moci (exekutíva, legislatíva a justícia).
