Abstract:
Práce pojednává o významu a úloze zavinění v trestním právu. Zavinění je jedním z nejvýznamnějších institutů v českém trestním právu. Podle trestního zákoníku č. 40/2019 Sb. dělíme zavinění na úmyslné a nedbalostní. Úmyslné zavinění má formu přímou a nepřímou. Nedbalost pak formu vědomou a nevědomou. Abstract:
The work discusses the meaning and function of fault in criminal law. Fault is one of the most important institutes in Czech criminal law. In compliance with Criminal code no. 40/2019 Coll. we divide fault to willful and caused by negligence. Willful fault has two forms and those are: direct and indirect.
