Abstract:

Základním cílem diplomové práce je představení, komparace a kritická reflexe tří legislativních úprav oblasti vnitřního řízení a kontroly ve veřejné správě (stávající účinné úpravy a dvou komplexních návrhů její revize). Text ve svém úvodu stručně definuje dílčí klíčové pojmy sledované problematiky (řízení, kontrola, audit ve veřejné správě atd.). Následuje rámcový popis základní struktury a obsahu těchto legislativních úprav. Na konci každé z kapitol jsou předmětné normy podrobeny kritické reflexi a srovnání vycházejícím z relevantních odborných zdrojů. V případě účinné zákonné úpravy je rovněž stručně nastíněna její aplikace v rámci vybraného ústředního orgánu státní správy. Závěr práce stručně představuje klíčové mezinárodní standardy v oblasti vnitřního řízení, kontroly a auditu ve veřejné správě (COSO a IIA), přičemž cílem je srovnání zohlednění těchto standardů ve sledované účinné zákonné úpravě a dvou návrzích její úplné revize.

Abstract:

The main objective of the diploma thesis is the presentation, comparison and the critical reflection of three legislative arrangements in the field of internal management and control in public administration. One of these arrangements has entered force, the two other proposals are the complex revisions of this document. In the introductory chapter, key partial concepts of the subject matter (management, control, audit in public administration, etc.) are defined. A framework description of the basic structure and the content of the three complex legislative arrangements follows. At the end of each chapter, the concerned norms are subjected to a critical reflection as well as compared based on relevant specialized literature. In the case of the legal arrangement in force, its implementation within the selected state administration’s body is also outlined. The work concludes by a presentation of key international standards in the field of internal management, control, and audit in public administration (COSO and IIA) with the aim of comparing how are these standards reflected in the concerned legal arrangement in force and the two proposals of its complete revision.
