Analysis of the Community Centres' Legal Structures in the District of Náchod

Abstract:

Práce si bere za cíl zhodnotit právní formy kulturních domů v okrese Náchod. Provoz kulturních domů v oblasti je zajímavý tím, že se tu nachází hned čtyři různé právní formy, ustavované podle tří zákonů.Rozboru samotných organizací předchází analýza prostředí, a to ze tří hledisek. Prvním je popis situace kulturních domů v České republice, druhým je detailní analýza legislativy, vztahující se především, nikoli však výhradně, k daným právním formám, a třetím jsou specifika regionu. Hlavní výzkumnou metodou je v této části studium literatury a dalších písemných pramenů. Výstupem je teoretický základ pro druhou část včetně stanovení kritérií pro porovnávání a posuzování právních forem.Analýza organizací je rozdělena na dvě části. Jedná se o kvalitativní výzkum na straně jedné a srovnání finančních ukazatelů na straně druhé. Obě části zahrnují kontext měst, v nichž se organizace nacházejí. V těchto kapitolách se výzkum opírá hlavně o dokumenty a další informace vydávané organizacemi a městy a o rozhovory s představiteli organizací.Následně práce posuzuje vhodnost jednotlivých právních forem a navrhuje optimální způsob ustavení kulturního domu. Jako vyhovující právní formy se na základě zvolených kritérií jeví zájmové sdružení právnických osob, spolek a ústav. Ze sedmi kulturních domů v okresu je tedy jediným vhodně ustaveným Městský klub v Novém Městě nad Metují.

Abstract:

The objective of the thesis is to evaluate the legal structures of the community centres in the district of Náchod. The administration of the community centres in the region is interesting because there are four different legal structures enacted under three different laws.Before the analysis of the institutions comes an analysis of the environment in three parts. The first one is a description of the situation of community centres in the Czech Republic, the second one is a detailed analysis of the legislation, related not only to the stated legal structures, and the third one deals with the specifics of the region. The main method of the research in this part is a study of literature and other written sources. The output of this part is a theoretical basis for the second part and a determination of the criteria for evaluating the legal structures.The analysis of the institutions is divided into two parts. It is a qualitative analysis on the one hand and a financial analysis on the other hand. Both of them include the context of the towns where the institutions are located. The main sources of the research in this part are documents and other information published by the institutions and the towns and interviews with the representatives of the institutions.At the end the thesis evaluates suitability of each legal structure and proposes an optimal way of establishment of a community centre. The best alternatives seem to be zájmové sdružení právnických osob (association of artificial persons), spolek (association) and ústav (institute). It means that the only suitably established community centre of the seven in the district is Městský klub v Novém Městě nad Metují.
