Abstract:

Tato diplomová práce se zabývá evropským právem proti nekalé soutěži dle úpravy dvou nejdůležitějších směrnic, směrnice 2005/29 o nekalých obchodních praktikách a směrnice 2006/114 o klamavé a srovnávací reklamě. Cílem práce je zhodnotit dosavadní evropskou úpravu nekalé soutěže s ohledem na judikaturu Soudního dvora Evropské unie, zhodnotit také úspěšnost transpozic vybraných směrnic do českého práva a najít odpověď na otázku, zda v dnešní době evropští občané nevyužívají spíše alternativní řešení spotřebitelských sporů, namísto soudního řízení. Práce je obsahově členěna do pěti kapitol. První kapitola vymezuje základní pojmy jako hospodářská soutěž, její subjekty a nekalá soutěž. Druhá kapitola pojednává o vývoji evropské hospodářské integrace. Třetí kapitola podává přehled o funkci Soudního dvora Evropské unie při provádění práva EU. Čtvrtá kapitola obsahuje skutkové podstaty nekalých obchodních praktik, vybraná rozhodnutí Soudního dvora a zkoumání úspěšnosti transpozic zmíněných směrnic do zákona o ochraně spotřebitele. Poslední kapitola se věnuje analýze využití alternativního řešení sporů mezi spotřebiteli a obchodníky. V práci je použita metoda deskriptivní, komparativní a analytická.

Abstract:

This thesis deals with European law against unfair competition under the two most important directives, Directive 2005/29 on unfair commercial practices and Directive 2006/114 on misleading and comparative advertising. The aim of the thesis is to evaluate the existing European rules on unfair competition in the light of the case-law of the Court of Justice of the European Union, also to assess the success of transpositions of selected directives into Czech law and to find an answer to the question of whether, today, European citizens are not using alternative solutions to consumer disputes, rather than judicial proceedings. The work is divided into five chapters. The first chapter sets out basic concepts such as competition, its actors and unfair competition. The second chapter deals with the development of European economic integration. The third chapter gives an overview of the function of the Court of Justice of the European Union in the implementation of EU law. The fourth chapter contains the facts of unfair commercial practices, the selected decisions of the Court of Justice and the examination of the success of the transpositions of those directives into the Consumer Protection Act. The last chapter deals with the analysis of the use of ADR between consumers and traders. The work uses a method of descriptive, comparative and analytical.
