Reservation to the Human Rights Treaties

Abstract:

My work deals with the issue of reservations in human rights treaties and problems that can occur during the process of submitting these reservations. I have concentrated on the reasons why reservations in human rights treaties might sometimes be more problematic than reservations in other treaties regulated by international public law. First of all, I described certain specific characteristics of human rights norms that distinguish them from general international rights norms. I looked at their origin as rights given to all people by the pure notion of their humanity. Then I compared the object of the human rights treaties with the object of other international rights instruments. The obligations regulated by human rights norms are not constructed on a state-to-state level, but on the contrary, they effect the relationships within the borders of the state – between the citizens and the state authorities. Human rights treaties also award a certain capacity to act to the persons, thus making them a subject of international law. The instrument of reservation protects the consent of the state, which is one of the most important concepts in international law. However, in the case of human rights, it might be outweighed, to a certain extent, by the object and purpose of the treaty. I looked at how a way of finding proportionality between the two values is constructed and how the possible negation of state consent can be justified. I analysed different doctrines that dominate the debate on legal consequences of incompatible reservations from the perspective of legal scholars and treaty bodies. I defined the severability doctrine, which is widely accepted, but I also tried to highlight some issues that might arise from the use of this principle. In my next chapter I analysed specific articles from various human rights treaties that cause the most legal conflicts. I introduced the concrete human rights instruments and their problematic provisions. I tried to find a pattern in some of the reasons why countries submit reservations to human rights treaties. I found several interesting examples where the purpose of the reservations not only serves to protect the state´s internal sovereignty but also expresses a broader value framework of the specific state. First I looked at the problem of universality in human rights. Both western and eastern opponents of the universality concept tend to describe human rights as an expression of western, Christian cultural tradition. I tried to demonstrate, using the works of Amartya San how these arguments are wrongly constructed and can serve to promote violations of human rights. On the contrary, I argue that only the concept of universal rights that belong to every person without prejudice can lead to the advancement of dignity and protection of all people. As a second example I took the believed conflict of Islamic law, Shariah with the law of human rights. The conflict is mostly apparent in the ambit of family rights. I present here the theory of Javaid Rehman in which he challenges the view that Shariah is completely incompatible with the concept of international human rights. Rehman shows that the problem does not lie with the law itself but only in the way in which it is interpreted by legal scholars and governments. Rehman further shows that even such an apparently rigid legal system cannot stand in light of social change. The last example I took from the USA. In American politics we can observe an interesting phenomenon. Although the process of forming human rights is closely connected to that of Europe, the USA possesses a special attitude towards capital punishment. The American government has submitted several reservations towards human rights treaties in order to protect the right to impose capital punishment. This is a completely contrary attitude to the process that is happening in Europe. I looked at some of the arguments Steiker proposed in order to explain this interesting phenomen

Moja diplomová práva sa zaoberá výhradami v ľudskoprávnych zmluvách a problémami, ktoré sa môžu pri procese podávania týchto výhrad vyskytnúť. Pokúsila som sa sústrediť na niektoré dôvody, pre ktoré výhrady voči ľudskoprávnym inštrumentom môžu by´t problematickejšie ako výhrady v tradičných zmluvách medzinárodného práva verejného. Popísala som určité vlastnosti ľudskoprávnych noriem, ktoré ich odlišujú od ostatných noriem medzinárodného práva. Zamerala som sa na pôvod ľudských práv, ktorý býva vyjadrovaný v teórií tak, že tieto práva sú človeku dané už zo samotnej podstaty ľudskosti. Ďalej som porovnala predmet ľudskoprávnych zmlúv s predmetom iných inštrumentov medzinárodného práva. Záväzky, ktoré upravujú normy ľudského práva nepôsobia na vzťahy medzi štátmi, ale naopak regulujú správanie štátnych orgánov voči občanom. Ľudské práva v určitých prípadoch priznávajú subjektivitu jednotlivcovi, čo ich tiež odlišuje od tradičného medzinárodného práva verejného. Inštrument podávania výhrad chráni súhlas štátu, ktorý je jednou zo základných podmienok medzinárodného práva pri tvorbe zmlúv. Avšak v prípade ľudských práv môže byť súhlas štátu prevážený obecným záujmom o univerzálnu ochranu práv. Snažila som sa vysvetliť pohľad práva ľudských práv na posúdenie váhy oboch záujmov a na spôsoby, akým môže byt zásah do súhlasu štátu ospravedlnený. Pozrela som sa na rôzne doktríny, ktoré sa snažia poskytnúť odpoveď na to, aké právne účinky bude mať predloženie nekompatibilných výhrad z pohľadu literatúry i rozhodovacej praxe súdov. Definovala som doktrínu severability, ktorá je prijímaná vo väčšine odborných kruhov, tiež som však poukázala na to, aké problémy môže použitie tejto doktríny spôsobovať. V ďalšej časti mojej práce som poukázala na konkrétne ustanovenia ľudskoprávnych dohôd, ktoré pri prijímaní spôsobovali najviac konfliktov. Snažila som sa popísať určité tendencie niektorých štátov k podávaniu výhrad. Medzi podanými výhradami som našla niekoľko zaujímavých príkladov, ktoré ukázali, že výhrady nemusia slúžiť iba na ochranu vnútornej suverenity, ale často môžu vyjadrovať širší hodnotový postoj štátu. Najprv som sa zaoberala problémom univerzality ľudských práv. Zo strany západných i východných oponentov konceptu univerzality sa najčastejšie spomína argument, že koncept ľudských práv je zavŕšením procesu formovania myslenia v západnom kultúrnom kontexte. Na práci Amartya Sana som ukázala, že podobné argumenty sú značne zjednodušujúce a slúžia predovšetkým k ospravedlneniu autoritárskych režimov. Naopak, jedine koncept univerzálnych ľudských práv môže zabezpečiť minimálny štandard ochrany pre všetkých ľudí sveta. Za druhý prípad kultúrne podmieneného odporu voči univerzalistickému konceptu som si vzala príklad Islamského práva Shariah a jeho rozporu s medzinárodným právom ľudských práv, ktorý sa prejavuje najmä v oblasti rodinného práva. Javaid Rehman vo svojej práci ukazuje, že Shariah nemusí vylučovať koncept ľudských práv, záleží iba na smere výkladu. Aj taký zdanlivo rigidný systém, akým je Shariah, však môže naopak podporiť implementáciu ľudských práv. Posledným príkladom, ktorý so rozoberala bol zaujímavý fenomén pochádzajúci z USA. Napriek tomu, že vo všetkých ostatných oblastiach ľudských práv postupuje USA skoro zhodne s európskymi krajinami, stále odmieta zrušiť na svojom území trest smrti. Pozrela som sa na niektoré argumenty Carol Steiker, ktorými sa pokúsila vysvetliť tento zaujímavý jav.
