Abstract:

Non-transposition of European Directives results to be costly for member states of the European Union. The non-implementation of Directives in Spain has been deteriorating in recent years. When looking at the Spanish situation of non-transposition, a puzzling situation emerges. The responsible actors for transposing EU directives are the central government and the Spanish autonomous regions (Comunidades Autónomas,CCAAs). Whenever european legislation falls under the competence of the CCAAs they are in charge of passing, executing and implementing legislation. Mostly both are involved in the transposition process through various institutionalized organizations and committees.The number of these institutions, where transposition is discussed have increased in recent years. However the directives are still transposed incorrectly, badly applied and not conform with european legislation. The thesis seeks to answer why there has been no improvement in transposition taking the example of the Urban Waste Water Treatment Directive in Spain.
