Abolition of the tax on the acquisition of immovable property

Abstract:

Bakalářská práce analyzuje zrušení daně z nabytí nemovitých věcí, dopad na ceny nemovitostí a realitní trh. V první části se zabývám obecnou charakteristikou daňové soustavy a daňového systému. V samostatné kapitole se věnuji samotné dani z nabytí nemovitých věcí, popisuji mechanismus fungování této daně, jak tomu bylo v České republice před jejím zrušením. V jednotlivých subkapitolách se zabývám konkrétními konstrukčními prvky daně z nabytí a jejím začlenění do daňové soustavy v ČR. Mapuji historii této daně, jak se vyvíjela, které předpisy ji upravovaly, její význam v minulosti a její formování až do její podoby před zrušením. V další kapitole přistupuji k samotnému zrušení této daně, jak probíhal legislativní proces a komparace se skutečnou praxí ze správy této daně. Analyzuji dopady zrušení, význam pro státní rozpočet v návaznosti na studii provedenou na téma zrušení a významu převodových daní. V praktické části představuji výsledky z mého dotazníkového šetření u realitních kanceláří a makléřů napříč Českou republikou. Dotazníkové šetření mi pomohlo získat potřebná data přímo od realitních kanceláří. Bylo zaměřeno na různé časové i věcné oblasti k tomuto tématu, jak před zrušením daně, tak i po něm. Sahalo i do doby, kdy jsme v českém daňovém systému měli daň z převodu nemovitých věcí. Výzkum byl přínosný, z výsledků lze usuzovat o vlivu na ceny realit a realitní trh v ČR.

Abstract:

The bachelor thesis analyses the abolition of the real estate acquisition tax, the impact on real estate prices and the real estate market. In the first part I deal with the general characteristics of the tax system. In a separate chapter, I discuss the real estate acquisition tax itself, describing the mechanism of its operation as it was in the Czech Republic before its abolition. In individual subchapters, I discuss the specific design elements of the acquisition tax and its integration into the tax system in the Czech Republic. I map the history of this tax, how it evolved, which regulations governed it, its importance in the past and its shaping up to its form before its abolition. In the next chapter, I approach the abolition of this tax itself, how the legislative process took place and a comparison with the actual practice of the administration of this tax. I analyze the effects of the repeal, the importance for the state budget following a study conducted on the repeal and the importance of transfer taxes. In the practical part I present the results of my questionnaire survey of real estate agencies and brokers across the Czech Republic. The questionnaire survey helped me to obtain the necessary data directly from real estate agents. It focused on different time and subject areas on this topic, both before and after the abolition of the tax. It also went back to the time when we had a real estate transfer tax in the Czech tax system. The research was useful, and the results suggest an impact on real estate prices and the real estate market in the Czech Republic.
