Proposal to Hold a Local Referendum

Abstract:

Diplomová práce se zabývá návrhem na konání místního referenda. Pozornost je věnována fázi od přípravy návrhu a sběru podpisů, jednotlivým náležitostem samotného návrhu a podpisové listiny, stanovení počtu oprávněných osob podporujících návrh, následné kontrole úřadem až po náležitosti výzvy v případě, že návrh má vady, a to s ohledem na judikaturu a porovnání závěrů soudů. Jejím cílem je objasnit podstatné skutečnosti, které jsou nezbytné k tomu, aby návrh přípravného výboru neměl vady a dát ucelený pohled na postup přípravného výboru od přípravy návrhu na konání místního referenda a sběru podpisů po jeho kontrolu úřadem a úkonů s tím spojených a dále poukázat na některé problematické aspekty současné právní úpravy s ohledem na výkladová stanoviska soudů.

Abstract:

This thesis deals with the proposal for carrying out a local referenda. Attention is given to the phase of the process from drafting and collecting signatures, individual essentials of the proposal and signing documents, determining the number of eligible subjects that support the proposal, and follow up commission supervision, up to the essential challenges in the event that the proposal has flaws, with regard to the case law and compared to the courts conclusion. The objective of this thesis is to clarify important facts that are essential for a flawless preparatory committee proposal, and give a comprehensive perspective on the proceedings of the preparatory committee from the proposal preparation for holding a local referenda and collecting signatures up to commission supervision and relating actions, furthermore the thesis points out some problematic aspects of present legislation with regard to the explanatory opinions of the courts.
