Parental rights of non-heterosexual parents

Abstract:

Tato diplomová práce si klade za cíl prozkoumat problematiku rodičovských práv neheterosexuálních rodičů, která je v současné moderní společnosti stále ještě poměrně tabuizovanou otázkou. V teoretické části práce je pojednáno o vnímání menšinové sexuální orientace od historie po současnost, dále pak o společenském pohledu na práva neheterosexuálních rodičů společně s argumenty pro a proti adopci dětí stejnopohlavními páry či o diskriminaci sexuálních menšin v oblasti rodičovských práv. V neposlední řadě je zde věnován prostor právním aspektům této problematiky, jako jsou například práva dítěte nebo uplatnění reprodukčních práv u lesbických žen. Poslední kapitola teoretické části je pak zaměřena na hledání možných cest k rodičovství neheterosexuálních osob z právního hlediska, právní pomoci a možnosti postupu proti diskriminačnímu jednání. Součástí práce je také praktická část, která prostřednictvím dvou dotazníkových výzkumů zjišťovala postoj jednak většinové heterosexuální společnosti k rodičovským právům neheterosexuálních rodičů a také to, zda se právě tito příslušníci sexuálních menšin cítí být v této oblasti diskriminováni.

Abstract:

The aim of this diploma thesis is to examine the issue of parental rights of non-heterosexual parents, which is still quite taboo issue in modern society. A theoretical part deals with the perception of minority sexual orientation from history to the present and it also deals with the social point of view on the rights of non-heterosexual parents together with pro and con arguments of same-sex couples to adopt children. The thesis focuses also on discrimination against sexual minorities in the area of parental rights. Finally, there is a section devoted to legal aspects of this issue, such as the rights of the child or the exercise of the reproductive rights of lesbian women. The last chapter of the theoretical part is focused on finding possible ways to parenthood of non-heterosexual persons legally, legal aid and a possibility of a process against discriminatory conduct. The work also includes a practical part with two questionnaire surveys. It describes the attitude of mainstream heterosexual society to the parental rights of non-heterosexual parents and also whether these members of sexual minorities feel discriminated against in this area.
