Tato diplomová práce pojednává o jednání, které obchází zákon. Tato jednání jsou v rámci právního řádu negativním jevem, který se zákonodárce snaží omezit. Cílem diplomové práce je vymezit obsah pojmu obcházení zákona, srovnat jeho aktuální úpravu s úpravou historickou a také porovnat obcházení zákona dle jiných občanských zákoníků platných v Evropě. This thesis discusses the action that circumvents the law. These actions are considered as negative phenomenon which the legislature seeks to limit. The thesis aims to define the concept of circumvention of the law, to compare its current regulation with the historical regulation and to compare circumvention of the law with other europian civil codes.
