Role of ombudsman in the control mechanism of the public administration in the Czech Republic

Abstract:

Bakalářská práce je zaměřena na roli ombudsmana v kontrolním mechanismu veřejné správy v České republice. Jejím cílem je zhodnotit efektivnost této instituce, pomocí kontrolní analýzy v oblasti veřejné správy, a jejich kontrolních mechanismů. Zároveň přibližuje veřejnosti obraz, co si pod pojmem instituce ombudsmana představit, a jakou pomoc od ní mohou očekávat v momentě, kdy se na ní obrátí. Z počátku se práce zaměřuje na původ vzniku této instituce a její jednotlivé etapy. Také, ale na nelehké prosazení ve své působnosti a zákonu, provázející jí až po současnost. Přibližuje i významné osobnosti, jako tomu byl JUDr. Otakar Motejl, první veřejný ochránce, který dal instituci ombudsmana směr, a to díky své obětavé povaze pomáhat proti neprávu. Jeho práce dodnes mezi veřejností není zapomenuta, a to jak v České republice, tak i ve světě. Dále práce nahlíží do konkrétních případů a popisuje ombudsmanův postup v šetření v momentě, kdy úřady veřejné správy pochybily, a občan se o pomoc obrací na instituci ombudsmana. Ne ale vždy ombudsman může pomoci z důvodu určitého rozsahu kompetencí, které mu byly svěřeny. Ohledně kompetencí se neustále vedou mezi veřejností rozepře, zda jsou dostatečné, nebo je potřeba je rozšířit. Tato úvaha byla zapracována také v dotazníku. Bakalářská práce zároveň hledá odpovědi na otázky, zda je postavení ombudsmana v kontrolním mechanismu rovno s jiným kontrolním systémem veřejné správy. Pomocí názorného popisu jednotlivých kontrol a vzájemných vztahů mezi nimi vyhodnotíme pomocí analýzy zmíněnou úvahu. Poznatky bakalářské práce jsou získány prostřednictvím odborné literatury, ale i názorů veřejnosti, jenž, byly také zaznamenány do dotazníku a kontrolní analýzy.

Abstract:

The bachelor thesis is focused on the role of ombudsman in the control mechanism of the public administration in the Czech Republic. Its aim is to evaluate the effectiveness of this institution, using a control analysis in the area of public administration, and its control mechanisms. At the same time, it gives the public a picture of what to imagine under the term of the Ombudsman institutions and what help they can expect from it in the moment they turn to it. At the beginning, the work focuses on the origin of this institution and its individual stages. However, it also focuses on difficult enforcement in its jurisdiction and law, accompanying it up to the present. It describes important personalities, such as JUDr. Otakar Motejl, the first public protector who gave to the institution of the Ombudsman its direction, thanks to his self-sacrificing nature to help fight against wrongdoing. His work has not been forgotten among the public, both in the Czech Republic and abroad. Furthermore, the work looks at specific cases and describes the Ombudsman's procedure in the moment the public authorities have made a mistake, and the citizen turns to the institution of the Ombudsman for help. But not always the Ombudsman can help because of the range of competences he has been given. Concerning the competences, there is a constant controversy among the public whether they are sufficient, or there is a need to be extend them. This consideration was also incorporated in the questionnaire. The thesis is looking for answers to the questions whether the position of the Ombudsman in the control mechanism is equal to another control system of public administration. By means of a demonstrative description of the individual controls and the mutual relations between them, we evaluate the mentioned consideration using an analysis. The findings of the bachelor thesis are obtained through professional literature as well as public opinion, which was also recorded in a questionnaire and control analysis.
