Schengen Area - freedom or the threat?

Abstract:

Volný pohyb osob je jednou ze čtyř základních svobod vnitřního trhu Evropské unie. Nalezení vhodného způsobu její realizace bylo od počátku Evropských společenství záležitostí velmi obtížnou, neboť bylo nutné spojit dvě protichůdná pravidla. Jednak to byl volný pohyb občanů Evropských společenství a následně Evropské unie v prostoru, který by nebyl omezen státními hranicemi členských států. Druhé pravidlo mělo důslednou kontrolou zajistit bezpečnost evropských občanů před nežádoucími osobami přicházejících ze třetích zemí. Řešením se stalo vytvoření Schengenského systému na základě Schengenských dohod, které byly podepsány v roce 1985 a 1990. Jeho princip fungoval na systému důsledné ochrany vnějších hranic, zatímco vnitřní hranice byly zrušeny. V posledních dvou letech se ozývají hlasy o opětovném zavedení ostrahy vnitřních hranic v souvislosti s migrační vlnou, která zasáhla státy Schengenu, neboť vnější hranice nebyla řádně zabezpečena. Tato diplomová práce je zaměřena na historii a současnost schengenského prostoru a posouzení jeho smysluplnosti v budoucnosti.

Abstract:

The free movement of persons is one of the four basic freedoms of the European Union's internal market. Finding the right way to implement it has been a very difficult task since the beginning of the European Communities, as it was necessary to combine two contradictory rules. Firstly, it was the free movement of citizens of the European Communities and consequently of the European Union in a space that would not be confined by the national borders of the Member States. The second rule was to control the safety of European citizens against undesirable persons coming from third countries. The solution has been to create a Schengen system based on the Schengen Agreements signed in 1985 and 1990. Its principle was to operate on a consistent system of external border control while internal borders were abolished. Over the past two years are heard voices on the reintroduction of internal border surveillance in connection with the migration wave affecting the Schengen States, as the external borders have not been properly secured This diploma thesis focuses on the history and present of the Schengen area and the assessment of its meaningfulness in the future.
