Possibilities of probation and mediation activities in the field of alternative punishments.

Abstract:

Podle mezinárodních organizací a odborných kruhů dochází stále ke zvyšování počtu vězněných osob. Tento stav a trend je výsledkem zvyšování trestní represe. Zvyšování trestní represe a aplikace nepodmíněných trestů odnětí svobody je zde v tomto místě chápána, jako reakce na růst kriminality. Podstatně se změnila struktura kriminálního jednání, došlo ke zvýšení nebezpečnosti některých forem zločinného jednání a objevily se nové druhy (terorismus, organizovaný zločin a tzv. obchod s "bílým masem"). Tento vývoj vyvolává oprávněné pochybnosti o účinnosti sankční politiky trestní justice. Již mnoho let se hovoří o tzv. "krizi trestu odnětí svobody". Problematika přeplněnosti českých věznic (bez ohledu na amnestii, která vyřešila tento problém pouze dočasně) se tak stává aktuálním tématem společnosti. S účinností od 1.1.2001 byla zřízena zákonem č.257/2000 Sb., Probační a mediační služba jenž vychází z principů restorativní justice. Jedním ze základních cílů Probační a mediační služby je v rámci možností asistovat při naplňování trestní spravedlnosti ve vztahu k výkonu a zajištění alternativních trestů. Jde o motivaci pachatele k odpovědnosti za spáchaný trestný čin, aby vedl řádný život bez konfliktu se zákonem, aby mohl vyjádřit svůj postoj ke spáchanému skutku a představu, jak napraví způsobenou škodu.

Abstract:

According to international organizations and professional circles is still increasing number of prisoners. This condition is the result of a trend increase in criminal repression. Increasing criminal repression and application of custodial sentences here in this place understood as a reaction to the growth of crime. Significantly changing the structure of criminal behavior, increased risk of certain types of criminal behavior, and there are new types of (terrorism, organized crime and the trade in "white meat"). This development raises legitimate doubts about the effectiveness of punitive criminal justice policies. For many years, there is talk of a "crisis of imprisonment." The issue of overcrowding in prisons Czech (regardless of the amnesty, which solved the problem only temporarily) becomes a hot topic company. With effect from January 1, 2001 was established by Act č.257/2000 Coll., Probation and Mediation Service which is based on the principles of restorative justice. One of the primary objectives of the Probation and Mediation Service is the possibility of assisting in the implementation of criminal justice in relation to performance and to provide alternative sentences. This is the motivation of the offender accountable for the offense to lead a decent life without conflict with the law, in order to express its position on the committed crime and the idea of how to remedy the damage caused.
