Political limits of review of norms exercised by constitutional courts

Abstract:

Moje disertační práce se soustředí na fenomén judicializace politiky. První kapitola rozebírá šíři diskrece v ústavním soudnictví, která je velmi široká. Z tohoto důvodu musí ústavní soudci pro rozhodnutí případů soudního přezkumu ústavnosti zákonů činit politicko-morální rozhodnutí. Druhá kapitola se soustředí na argumenty podporující soudní přezkum ústavnosti zákonů a argumenty proti němu. Třetí kapitola se zabývá limity omezující šíři diskrece ústavních soudů. Soudci nepůsobí v izolaci a rozhodnutí o ústavnosti zákona záleží také na faktorech, jako jsou veřejné mínění nebo priority hlavních politických stran v zemi. Výsledky podrobné analýzy soudních rozhodnutí českého Ústavního soudu zabývající se tématy rozebíranými v předešlých kapitolách, jsou představeny ve čtvrté kapitole. Závěry této analýzy ukazují, jak často soudci diskutují o vztahu k parlamentu nebo o jakých limitech se zmiňují anebo jak tyto limity ovlivňují jejich rozhodnutí o ústavnosti zákona.

Abstract:

My thesis focuses on the phenomenon of the judicialization of politics. The first chapter discusses the scope of judicial discretion in constitutional adjudication which is very broad. Therefore, constitutional judges have to make political-moral judgments to resolve the cases of judicial review of legislation. The second chapter focuses on arguments favouring the judicial review and arguments against it. The third chapter deals with limits restricting the scope of discretion of the constitutional courts. Judges do not operate in isolation and the final decision about the constitutionality of an act depends also on factors like public opinion or priorities of the leading political parties in the country. The outcomes of a deep analysis of the jurisprudence of the Czech Constitutional Court relating to issues elaborated in previous chapters are presented in the fourth chapter. The results of this analysis show how often judges discuss their relation to parliament or what limits are they concerned about and how these limitis influences their judgment about the constitutionality of an act.
