Abstract:

Tato diplomová práce komplexně popisuje téma ochrany povinné osoby v exekučním řízení. Je v ní vymezena zásada povinné osoby jako základní prvek. Práce nabízí čtenáři udělat si lepší názor na exekuční řízení a soudní exekutory. V úvodu diplomové práce je uvedeno několik cílů, kterých má být touto prací dosaženo. Celá práce je členěna na osm kapitol. Druhá a třetí kapitola obecně popisuje exekuční řízení a subjekty exekučního řízení, pro lepší pochopení ochrany povinné osoby. Je v nich vymezeno, kdo je soudní exekutor, co je exekuční řízení a průběh exekučního řízení. Dále obsahují popis subjektů exekučního řízení, a zaměřují se na dva základní - oprávněnou osobu a povinnou osobu. To je pro tuto práci základní východisko. Čtvrtá kapitola pomáhá lépe pochopit postavení povinné osoby v exekučním řízení, protože vymezuje základní zásadu - zásadu ochrany a obrany povinné osoby. Je důležité v práci popisovat i obranu, protože se skrz ní uskutečňuje ochrana. Z této kapitoly plyne, že v zákoně je mnoho prvků ochrany povinné osoby. Pátá kapitola je věnována historii ochrany povinné osoby. To je důležité pro pochopení následující kapitoly, ve které jsou uvedeny konkrétní příklady institutů ochrany a obrany povinné osoby. V této kapitole je také napsáno, v čem můžeme vidět prvek ochrany povinné osoby v jednotlivých institutech. V poslední sedmé kapitole, která je o ochraně povinné osoby, jsou rozebrány dopady institutů ochrany a obrany povinné osoby na exekuční řízení. Je z toho jasné, že jsou prvky ochrany a obrany mocné, a můžou způsobit i malé i velké dopady. Závěr je věnovaný vyřešení cílů, které jsou popsány v úvodu.

Abstract:

This diploma thesis comprehensively describes the subject of protection of a liable entity in execution proceedings. It defines principle of protection of the liable entity as an essential element. The thesis offers the reader a better view of execution proceedings and executors. In the introduction of the thesis, there are several goals that should be achieved by this work. The entire thesis is divided into eight chapters. The second and third chapters generally describe the execution proceedings and the subjects of execution proceedings, to better understand the protection of the liable entity. This thesis defines the execution procedure and the course of execution proceedings. In addition, it contains a description of the bodies of execution proceedings and focuses on the two basic ones - the beneficiary and the liable entity. This is the basis for this thesis. The fourth chapter helps to better understand the position of the liable entity in execution proceedings because it defines the basic principle - the principle of protection and the defense of the liable entity. It is important to describe the defense in the work because protection is realized through it. This chapter shows that in the law there are a lot of elements concerning the liable entity's protection. The fifth chapter is devoted to the history of the protection of liable entities. This is important for understanding the following chapter, which gives concrete examples of the protection of liable entities and defense institutes. The element of protection of the liable entity in individual institutes is also written about in this chapter. In the last chapter, which is about the protection of the liable entity, the impact of the protection and defense institutes of the liable entity on execution proceedings is discussed. It is clear that the elements of protection and defense are powerful, while they can cause small and large impacts. The conclusion is devoted to solving the objectives described in the introduction.
