Remedies against Delays in Proceedings and their Consequences

Abstract:

Tato diplomová práce se zabývá prostředky proti průtahům v řízení a jejich následkům. Pokud státy nejsou schopny stoprocentně dostát požadavku přiměřené délky řízení, pak je bezpochyby nejefektivnějším řešením preventivní prostředek proti průtahům v řízení, jež umožní účastníkům taková řízení urychlit a ochránit je dříve, než délka řízení překroční přiměřenou mez. Mezi prostředky, jež mají nedůvodnému protahování řízení zabránit, můžeme řadit stížnost na průtahy k orgánu státní správy soudů dle § 164 a násl. zákona č. 6/2002 Sb., o soudech a soudcích a dále návrh na určení lhůty k provedení procesního úkonu dle téhož zákona. Bylo-li postupem soudu zasaženo do základního práva chráněného ústavním zákonem, nabízí se jako třetí možnost podání ústavní stížnosti podle § 72 a násl. zákona č. 182/1993 Sb., o Ústavním soudu. V případě, kdy řízení je průtahy již zatíženo a preventivní prostředky nejsou schopny účastníkům pomoci, nabízí státy prostřednictvím kompenzačních prostředků možnost odškodnění újmy vzniklé takovým postupem soudu. V právním řádu České republiky tuto roli plní zákon č. 82/1998 Sb.

Abstract:

The thesis deals with remedies against delays in proceedings and their consequences. If the countries are unable to fully meet the requirement of a reasonable length of proceedings, the most efficient solution is, undoubtedly, preventive means against delays in the proceedings in order to enable the parties to expedite these proceedings and to protect the participants before the trial period exceeds the reasonable limit. The appeal to a higher authority to the authority of state administration of courts according to the section 164 and ff. Law no. 6/2002 Coll., on courts and judges and the motion for the deadline for the performence of a procedural act according to the section 174a under the same law are two of the legal remedies which are intended to prevent the unreasonable prolongation of the proceedings. A constitutional appeal under section 72 et seq. Act no. 182/1993 Coll., on the Constitutional Court is a third option offered the participants, provided that the court violated their fundamental rights protected by constitutional law. In case when proceeding is already delayed and the preventive remedies cannot help the parties, the States offer the possibility of redress by compensation remedies. The Czech law performs this role through Act no. 82/1998 Coll.
