Administrative Torts in the Light of Judicature

Abstract:

Anotace Bakalářská práce se soustředí na téma správního trestání, na pojem správního deliktu, jeho znaky a klasifikaci na jednotlivé druhy správních deliktů. Konkrétně se zaměřuje na problematiku přestupků proti bezpečnosti a plynulosti provozu na pozemních komunikacích. První kapitola je věnována správnímu trestání, zejména pramenům jejich úpravy a zásadám, které se správního trestání dotýkají. Druhá kapitola zahrnuje definici pojmu správní delikt a v jednotlivých podkapitolách pojednává o pojmových znacích správního deliktu. Třetí kapitola se zabývá rozdíly mezi správními a soudními delikty. Snažil jsme se uvést co nejvíce diferenciačních kritérií mezi správními delikty a trestnými činy. Čtvrtá kapitola se soustředí na klasifikaci správních deliktů. Jednotlivé skupiny správních deliktů jsou podrobněji popsány v podkapitolách. V poslední kapitole jsem se zaměřil na problematiku přestupků proti bezpečnosti a plynulosti provozu na pozemních komunikacích, kde jsem se zabýval rozdílem mezi termínem „dopravní přestupek“ a přestupek proti bezpečnosti a plynulosti provozu na pozemních komunikacích, dále jsem rozebral jednotlivé skutkové podstaty přestupků upravených v § 22 zákona o přestupcích a v poslední podkapitole jsem zhodnotil současnou situaci a navrhnul jsem možná řešení problémy spojených s přestupky proti silničnímu provozu. Na tuto kapitolu navazují přílohy, které obsahují statistiky vedené Ministerstvem vnitra. Celá práce je doplněna odkazy na judikaturu soudů, čímž chci zdůraznit její nenahraditelný přínos v oblasti správního trestání. Úprava správních deliktů je z mnoha pohledů nedokonalá. Judikatura soudů napomáhá výkladu nejasných pojmů a vyplňuje mezery úpravy.

Abstract:

Annotation Bachelor thesis focuses on the administrative punishment, the concept of an administrative offense, its characters and classification of different types of administrative offenses. Specifically, it focuses on issues of offenses against the safety and smooth traffic. The first chapter is devoted to administrative punishment, particularly the sources of their principles and rules that affect the administrative punishment. The second chapter includes a definition of an administrative offense and each subchapter discusses the conceptual features of an administrative offense. The third chapter deals with the differences between administrative and judicial offenses. We tried to bring as many of the criteria of differentiation between administrative offenses and crimes. The fourth chapter focuses on the classification of administrative offenses. Individual groups of administrative offenses are described in subchapters. In the last chapter, I focused on the issue of offenses against traffic safety and on the road, where I addressed the difference between the term "traffic offense" and violation of traffic safety and road, as I disassembled the individual facts of the offenses provided for in § 22 of the Law on misdemeanors in the last charter I have reviewed the current situation and proposed possible solutions to problems associated with road traffic offenses. This chapter follow the Annex, which contains statistics of the Ministry of Interior. The whole work is supplemented by references to the jurisprudence of the courts, so I want to stress her irreplaceable contribution to administrative punishment. Arrangements for administrative offenses is in many respects imperfect. Helping the judicial interpretation of vague concepts and fills the gap adjustment.
