Overriding Mandatory Rules in Private International Law
Abstract:
Tato diplomová práce se zabývá imperativními normami v mezinárodním právu soukromém. V první části zkoumá tyto normy z pohledu obecné právní teorie. V další částí zkoumá tzv. veřejný pořádek a výhradu veřejného pořádku. Následně se věnuje interakci imperativních norem a kolizní metody v MPS. This thesis deals with the overriding mandatory rules in the Private international law. First, it examines these provisions from the general legal theory perspective. Then it is considered with so-called orde public and the ordre public exception.
