Orchestras and the Public Cultural Institutions Act

Abstract:

Cílem této práce zaměřené na symfonické orchestry je určit, jestli je pro jejich zdárný chod a dobrý budoucí vývoj potřeba, aby byla parlamentem přijata pomocí zákona nová právní forma, která by byla vytvořena přímo pro tento typ činnosti. Nejdříve bude v teoretické části práce zmapován současný stav z hlediska organizačního nastavení profesionálních orchestrů na území ČR, a to včetně dosavadního poznání z oblasti kulturního managementu. Dále bude určena a rozebrána relevantní právní úprava. Následovat bude rozbor současného stavu úvah o zavedení veřejné kulturní instituce do českého právního řádu. V praktické části práce bude proveden empirický výzkum zaměřený jak na postoje vedení orchestrů k této otázce, tak i na stanovisko ministerstva kultury. Dále budou zkoumány i ekonomické a organizační aspekty této problematiky. Závěry práce budou obsahovat i úvahy de lege ferenda ohledně nastavení fungování orchestrů vzhledem k jejich společenské a umělecké funkci, a to s důrazem na otázku jejich právní formy.

Abstract:

The aim of this thesis, which focuses on symphony orchestras, is to determine whether a new legal form created specifically for this type of entity needs to be adopted by the Parliament by means of a law in order to ensure their successful operation and good future development. First, the theoretical part of the thesis maps the current situation in terms of the organisational set-up of professional orchestras in the Czech Republic, including the existing knowledge in the field of cultural management. Then the relevant legislation is identified and discussed. This is followed by an analysis of the current state of considerations on the introduction of public cultural institutions into the Czech legal system. In the practical part of the thesis, empirical research is conducted, focusing on the attitudes of orchestra managements towards this issue as well as on the position of the ministry of culture. Furthermore, the economic and organisational aspects of this issue are examined. The conclusion of the thesis also includes de lege ferenda considerations regarding the setting of orchestras' functioning in relation to their social and artistic function, with emphasis on the question of their legal form.
