Dissolution and settlement of spouses joint property

Abstract:

Tato práce se zabývá institutem společného jmění manželů se zaměřením na jeho skončení a vypořádání. V rámci práce charakterizuji institut zejména z pohledu úpravy zákona č. 89/2012 Sb., Nový občanský zákoník, ale představím ho i z pohledu předchozích právních úprav. Cílem práce je představit problematiku společného jmění manželů a poukázat na aspekty, které při řešení daných problémů mohou nastat. V první části práce je představen náhled do historie společného jmění manželů. V dalších částech práce je představen institut společného jmění manželů, zánik společného jmění manželů a v poslední kapitole je představeno vypořádání SJM.

Abstract:

This work deals with the institution of common property of spouses with a focus on its termination and settlement. As part of the work, I characterize the institute mainly from the point of view of the amendment of Act No. 89/2012 Coll., New Civil Code, but I will also present it from the point of view of previous legal amendments. The aim of the thesis is to present the issue of joint property of spouses and to point out the aspects that may arise when solving the given problems. In the first part of the work, an overview of the history of the joint property of the spouses is presented. in the other parts of the work, the institute of joint property of spouses, the termination of joint property of spouses is presented, and in the last chapter, the settlement of SJM is presented.
