Regulatory Fees in Medical Devices

Abstract:

Institut regulačních poplatků představuje první část reformy zdravotnictví. Jejich účelem je zabránit plýtvání a zneužívání zdravotní péče ze strany pacientů a zajištění dalšího zdroje financování zdravotnictví. Regulační poplatky platí pacient v souvislosti s poskytováním zdravotní péče hrazené z veřejného zdravotního pojištění, a to zdravotnickému zařízení, které tuto péči poskytlo a jsou současně jeho příjmem. Regulační poplatky tedy neplynou do veřejných rozpočtů, jedná se o poplatky soukromoprávního charakteru. Diplomová práce se zabývá jejich zavedením v kontextu celé reformy a dynamickým vývojem právní úpravy a jejího výkladu od počátku účinnosti do března 2009. Zvláštní pozornost je věnována předmětu poplatků, osvobození, výši a placení a také ochrannému limitu. V závěru práce jsou shrnuty dosavadní výsledky dopadu právní úpravy, jejich zhodnocení a úvahy de lege ferenda.

Abstract:

The legal institution of the regulatory fees represents the first part of the health system reform. The object of these fees is to prevent the patients from squandering and abuse of the medical care and to provide the health system with another financial resource. The regulatory fees are paid by the patient in connection with health care covered by the public health insurance to the medical facility that provided the health care. The fees produce revenue to the facility, they do not actually flow into the public budget, they are a kind of a private legal charge. The thesis deals with the implementation of the regulatory fees in context of the reform as a whole and the dynamic development of the legal regulation and its interpretation from the beginning of its legal effectiveness until March 2009. Special attention is dedicated to the object of the fees, the exemption, the amount of the fees and their payment and the protective limit as well. In the end of the thesis there is a summary of the present results of the impact of the legal regulation, the evaluation of the results and my own proposal de lege ferenda.
