The position of Great Britain to the EU Charter of Fundamental Rights in the process of formulation and adoption of EU primary law revisions

Abstract:

Bakalářská práce se primárně zabývá postojem vlád Velké Británie k Listině základních práv EU od počátku vzniku Listiny až do 13. prosince 2007, kdy byla podepsána Lisabonská smlouva. Práce mapuje postoje Velké Británie a výsledky vyjednávání, kterých britské vlády dosáhly ve Smlouvě z Nice, v Ústavní smlouvě a v Lisabonské smlouvě. Práce pracuje s hypotézou: "Postoj britských vlád k Listině základních práv EU je po celou dobu, kdy má Evropská unie snahu Listinu začlenit do primárního práva, konzistentní." Důvodem k výběru tohoto tématu je vyjednaná výjimka vůči platnosti Listiny, kterou si Velká Británie vyjednala v rámci Lisabonské smlouvy v podobě připojeného Protokolu.

Abstract:

This bachelor diploma work deals with the position of the UK governments to the Charter of Fundamental Rights from the beginning of the charter until 13th Dec 2007 when the Lisbon Treaty was signed. The paper studies the attituted of the UK and results of negotiations which the UK governments achieved in the Treaty of Nice, the Treaty establishing a Constitution for Europe and the Lisbon Treaty. Also, this project takes into consideration the hypothesis that the attitude of the UK governments to the Charter is consistent throughout the whole period of EU's attempt to include the Charter in the Primary law. The reason for choosing the topic is the negotiated exception of the legitimacy of the charter that has been achieved by the UK government as a part of the Lisabon treaty as a form of protocol.
