Abstract:

Diplomová práce se primárně zaměřuje na autorské právo, které představuje důležitý právní rámec chránící autora díla proti zneužití autorského díla třetí stranou. Cílem této práce je informovat o aspektech autorskoprávní ochrany ve vztahu k počítačovému softwaru v rámci České republiky, ale stručně je pojednáno také o autorskoprávní ochraně v USA. Výklad je doplněn o výčet několika poměrně hojně využívaných licencí. Opomenuta nezůstala ani jiná právní odvětví a stručně je rozebrána ochrana poskytovaná například trestním a správním právem, ochrana s využitím patentu a ochrana proti nekalé soutěži. Každá z nich má totiž své výhody, ale také nevýhody a může být žádoucí, aby se vzájemně doplňovaly. Autorskoprávní ochrana je navíc velmi významně ovlivněna multilaterálními mezinárodními smlouvami, a proto ty nejvýznamnější jsou v práci spolu s evropskou legislativou představeny. V závěru práce je věnován prostor výběru z tematicky relevantní judikatury.

Abstract:

The diploma thesis primarily focuses on copyright, which forms an important legal framework for the protection of authors of works against abuse of their copyrighted works by third parties. The aim of this thesis is to provide information on the aspects of copyright protection in relation to computer software within the Czech Republic; however, the thesis also briefly discusses copyright protection in the USA. The explanation is supplemented by a list of several relatively abundantly used licences. The thesis does not neglect even other branches of law and briefly analyses protection provided, for instance, by the criminal law and the administrative law, protection using patents, and protection against unfair competition. Each of these types of protection has its advantages and disadvantages and it may be desirable for them to complement each other. Moreover, copyright protection is very significantly influenced by multilateral international contracts; therefore, the thesis introduces the most important ones together with the European legislation. The conclusion of the thesis leaves room for a selection of topically relevant judgments.
