Tato diplomová práce se zaobírá problematikou konsensu stran s důrazem na fázi uznání a výkonu cizího rozhodčího nálezu. Práce nejprve analyzuje otázku materiální platnosti rozhodčí smlouvy a popisuje přístupy, které praxe zaujala k otázce určení osobního rozsahu rozhodčí smlouvy. This diploma thesis deals with the question regarding the parties‘ consent with emphasis on the stage of recognition and enforcement of a foreign arbitral award.
