Práce se zabývá poměrně málo diskutovanou otázkou, zda jsou účastníci soukromoprávních vztahů vázáni také ustanoveními základních práv a svobod. Uvedená práva mají totiž své primární poslání v regulaci základních vztahů mezi státem a občany, resp. mezi osobami, které se nacházejí pod jurisdikcí tohoto státu. The work revers to the relatively little discussed issue about whether the participants of private legal relations are bound by fundamental rights and freedoms. These rights regulate so to say in the first place the relations between the state and its citizens, or more precisely between the persons which are under the jurisdiction of such state.
