Alternative punishments, role and activities of the Probation and Mediation Service of the Czech Republic

Abstract:

Bakalářská práce se zabývá problematikou alternativních trestů a institucí Probační a mediační služby ČR. Cílem práce je poskytnout ucelený pohled na téma alternativního trestání, analyzovat výhody a nevýhody vybraných alternativ k nepodmíněnému trestu odnětí svobody a objasnit roli a činnosti Probační a mediační služby ČR. Text práce je rozdělen na tři části a celkem šest kapitol tak, aby bylo dosaženo stanoveného cíle. První část práce se věnuje teoretickému základu problematiky trestního práva, restorativní justice a alternativních opatření. Druhá část se zaměřuje na roli, účel a činnosti instituce Probační a mediační služby ČR a na vybrané alternativy k nepodmíněnému trestu odnětí svobody a tvoří stěžejní část práce. Práce je doplněna také výzkumnou částí, ve které je provedeno kvantitativní anonymní výzkumné šetření zaměřené na míru informovanosti a postoje veřejnosti k ukládání alternativních trestů a na míru informovanosti a postoje veřejnosti k instituci Probační a mediační služby ČR. Výsledky výzkumu jsou v závěru práce analyzovány a interpretovány.

Abstract:

This bachelor thesis deals with the issue of alternative sentences and the institution of the Probation and Mediation Service of the Czech Republic. The aim of the thesis is to provide a comprehensive view of the topic of alternative sentences, to analyse the advantages and disadvantages of selected alternatives to unconditional imprisonment and to explain the role and activities of the Probation and Mediation Service of the Czech Republic. The text of the thesis is divided into three parts and the total of six chapters in order to achieve the stated objective. The first part of the thesis deals with the theoretical basis of criminal law, restorative justice and alternative measures. The second part focuses on the role, purpose and activities of the institution of the Probation and Mediation Service of the Czech Republic and on selected alternatives to unconditional imprisonment and forms the main part of the thesis. The thesis is also supplemented with a research part, in which a quantitative anonymous research survey is carried out focusing on the level of public awareness of and attitudes to the imposition of alternative sentences and the institution of the Probation and Mediation Service of the Czech Republic. The results of the research are analysed and interpreted at the end of the thesis.
