Trade relations between USA and China with focus on Intellectual Property Rights

Abstract:

Tato bakalářská práce se zabývá obchodními vztahy mezi USA a Čínou s bližším zaměřením na oblast práv duševního vlastnictví. Jejím hlavním cílem je zhodnotit, zda a do jaké míry se do americko-čínského partneství promítá problematika duševního vlastnictví. Práce je rozdělena do tří kapitol. První kapitola je věnována historickému vývoji ekonomických a politických vztahů mezi těmito mocnostmi od počátků do současnosti. Druhá kapitola popisuje současný stav americko-čínských obchodních vztahů. Zahrnuje charakteristiky a srovnání obou ekonomik z hlediska makroekonomických ukazatelů. Zároveň také shrnuje údaje o aktuální obchodní výměně mezi zeměmi. Třetí kapitola je zameřena na oblast práv duševního vlastnictví. Obsahuje vymezení důležitých pojmů pro pochopení problematiky, porovnání legislativních úprav v obou zemích a popis rozdílů v přístupech obou zemí k jejich ochraně. Pozornost je však věnována zejména popisu vzájemné bilance USA a Číny v oblasti duševního vlastnictví, tedy chronologickému shrnutí této problematiky v jejich vzájemném vztahu.

Abstract:

This bachelor thesis deals with trade relations between the USA and China with a closer focus on Intellectual Property Rights (IPR). The aim is to evaluate whether and to what extent the issue of intellectual property is reflected in US-Chinese partnership. The thesis is divided into three chapters. The first chapter is dedicated to the historical development of economic and political relations between these powers from the beginning to the present. The second chapter describes current US-Chinese trade relations. It includes characteristics and comparison of both economies in terms of macroeconomic indicators and also summarizes data on current trade between countries. The third chapter is focused on Intellectual Property Rights. It contains the definition of important terms for understanding the issue, comparison of legislation in both countries, and description of the differences in the approaches of both countries to their protection. However, special attention is paid to the description of the mutual balance of the USA and China in the field of intellectual property rights, specifically a chronological summary of this issue in their mutual relationship.
