Abstract:

Tato diplomová práce se zabývá analýzou právní úpravy institutu opatření obecné povahy se zaměřením na judikatorní a doktrinální výklady vybraných problematických ustanovení dotčených právních předpisů. Vedle vymezení pojmu opatření obecné povahy se v práci věnuji procesu jeho tvorby. Součástí práce je rovněž analýza možností přezkumu opatření obecné povahy s důrazem na jejich vzájemný vztah a efektivnost. Cílem práce je poukázat na nedostatky současné právní úpravy opatření obecné povahy a navrhnout jejich možné řešení, ať již cestou výkladu sporných ustanovení či návrhů de lege ferenda.

Abstract:

This dissertations deals with the analysis of the legislation related to the institute of the general measure focusing on judicial and doctrinal interpretations of the selected problematic provisions of the related legislation. In this thesis I deal with both the definition of the general measure and the proces of its creation. This thesis also analyzes the possibilities of the review of general measure with the emphasis on their mutual relationship and efficiency. The aim of this thesis is to highlight the shortcomings of current legislation of general measure and to propose possible solutions either through the interpretation of the disputed provision or suggestions de lege ferenda.
