Current issues of criminal activity committed on youth

Abstract:

Tato disertační práce vychází ze skutečnosti, že trestná činnost páchaná na mládeži je závažným celospolečenským problémem, který zasahuje nejrůznější oblasti života populace. Navíc jde o jev trvalý a často diskutovaný. Trestná činnost páchaná na mládeži zasluhuje z hlediska hlubšího odborného zkoumání pozornost už proto, že je provázána na další sociálně patologické jevy, přičemž jejich vazby jsou podmiňující a opakující se. Práce je na soustředěna na dimenzi kriminologickou a trestněprávní. Identifikace vzájemných vazeb těchto dvou disciplín je důležitá jak z hlediska stanovení efektivnosti platného práva, tak i pro úvahy o právu budoucím. Vlastní trestněprávní materie je budována na poznání a hodnocení širších kontextů. Poznatky jiných společenských věd jsou zde využity ke kritickému posouzení pozitivně právní úpravy. Téma trestné činnosti páchané na mládeži lze považovat za vysoce aktuální. Znak aktuálnosti je předpokladem, že pojednání bude mít podíl na řešení současných otázek a že neustrne na opakování názorů již dávno překonaných. Znalost trestné činnosti páchané na mládeži vyústila v rozhodnutí, aby se tato práce soustředila na aktuální otázky i z hlediska vnitřní výstavby. To znamená na takové, o nichž je na odborné úrovni opakovaně a v širším odborném záběru vedena rozprava. Nejsou však opomenuty ani problémy méně diskutované, které společnost nepříznivě zasahují. Aktuální jsou zejména otázky, které souvisejí s rekodifikací trestního práva hmotného a procesního. V procesu schvalování nových zákonů je žádoucí se ptát, jak zamýšlené změny právní úpravy mohou ovlivnit stav kriminality, promyslet a propracovat ustanovení. Zde sledujeme legislativní rovinu. Vedle tohoto stojí rovina aplikační, kde je možné dohledat problémy, které se v kontextu trestné činnosti páchané na mládeži objevují v právní praxi, zejména jsou obsaženy v judikatuře. Kromě výkladu platné právní úpravy jde také o komentář k těm společenským jevům, které stojí mimo pozornost právní úpravy, nebo které jsou takovou reglementací podchyceny neúplně a nedostatečně. Hlavním cílem předkládané práce je identifikovat klíčové a zároveň aktuální problémy kriminality páchané na mládeži v České republice, podat jejich analýzu a zhodnocení, jakož i provést důkladný rozbor trestněprávní ochrany mládeže, zejména z pohledu jejího obsahu v trestním zákoníku účinném od 1. 1. 2010. K tomuto hlavnímu cíli přistupují dílčí cíle, které mu dávají zřetelnější obrysy a které se promítají do zvolené struktury práce. Vysvětleny jsou základní pojmy tématu trestné činnosti páchané na mládeži a vymezeny její typické znaky. Ozřejměna jsou specifika kriminologické charakteristiky trestné činnosti páchané na mládeži jak z hlediska stavu, vývoje a struktury, tak z pohledu příčin a podmínek kriminality. Identifikovány byly aktuální jevy trestné činnosti páchané na mládeži, jako je kyberšikana, partnerské násilí, podávání alkoholických nápojů a podávání anabolických látek, a přitom byl podán jejich kriminologický obraz. Práce nabízí nástin postavení mládeže v mezinárodních dokumentech i v právním řádu České republiky. Definovány jsou stěžejní body trestněprávní ochrany mládeže v trestním zákoně a zvláště v novém trestním zákoníku. Práce si také všímá nejdůležitějších trestněprocesních souvislostí trestné činnosti páchané na mládeži, kam patří postavení dítěte jako poškozeného v trestním řízení, výslech osoby mladší patnácti let a ochrana soukromí dítěte v trestním řízení. Realizován byl viktimologický výzkum, a to s cílem zmapovat názory a zkušenosti staršíc

h žáků druhého stupně základních škol v oblasti kriminality páchané na mládeži. Na závěr je uvedeno shrnutí k současnému poznávání trestné činnosti páchané na mládeži a k jejím možným perspektivám. Disertační práce je sepsána jako analytická studie. Podává přehled o kriminalitě páchané na mládeži a staví ji do různých kriminologických a trestněprávních souvislostí. Rozebrány jsou teoretické otázky, které se týkají kriminality páchané na mládeži a ochrany mládeže v právním řádu, zobecněny jsou zkušenosti s trestním zákonem a kriticky je zhodnocen nový trestní zákoník. Práce si všímá aplikačních problémů a snaží se předložit možnosti jejich řešení. V zájmu snazšího porozumění je materie doložena desítkami skutečných kauz. Jedná se o první dílo, které podrobně a systematicky zpracovává problematiku trestné činnosti páchané na mládeži v České republice. O zpracování některých aktuálních kriminologických a trestněprávních poznatků z této oblasti se uvedená práce pokouší vůbec poprvé.

Abstract:

This thesis is based on the fact that criminal activity committed on youth is a serious society-wide problem which interferes in different fields of life of population. Moreover it is a continuous and often disputed phenomenon. In view of closer expert examination the crimes committed on youth deserve attention, if not for other reasons, then because they are linked with other socially pathologic effects with their links being interconditional and repeating. The thesis is focused on a criminological and penal law dimension. To identify the interrelations between these two disciplines is a key problem both in terms of examining the efficiency of valid legislation and in terms of contemplations regarding future law. The penal law issue is built on knowledge and evaluation of wider context. Knowledge of other social sciences is utilized for a critical assessment of enacted legislation. The topic of criminal activities committed on youth may be regarded as highly up-to-date. An element of up-to-dateness is a prerequisite of the fact that the thesis will contribute to resolving the current question and not get stuck on repeating the opinions long since overcome. Knowledge in the sphere of criminal activity committed on youth resulted in a decision to focus this thesis on current issues also in terms of their inner structure. It means on the issues which are subject of repeated discussions at expert level from a wider expert perspective. However, the less discussed issues which adversely affect the society have not been omitted either. Those issues are especially up-to-date which relate to recodification of subjective and objective penal law. In the procedure of enacting new laws it is necessary to ask how the contemplated amendments to legislation may affect criminality levels, to think over and work through the legal provisions. At this point we follow the legislation level. But, aside it stands the application level from which the issues may be retrieved which in the context of criminal activity committed on youth appear in legal practice, namely they are included in case law. In addition to the interpretation of the valid legislation it is also a commentary on the social phenomena which stand outside the attention of legislation or which are resolved by the regulation, nevertheless incompletely or insufficiently. The main objective of the presented work is to identify key and at the same time current problems of criminality committed on youth in the Czech Republic, to analyze and assess them as well as to thoroughly analyze the criminal law protection of youth, namely in view of its contents in the Penal Code in effect from 1. 1. 2010. This main objective is accompanied with partial objectives which give more distinct contours to it and which are reflected in the selected structure of the work. The work includes the explanation of basic terms of the topic of criminal activity committed on youth and definition of its typical features. The work also clarifies the specifics of criminological character of criminal activity committed on youth both in terms of current conditions, development and structure, and from the perspective of causes and conditions of criminality. The work identifies the current phenomena of criminal activity committed on youth, such as cyber harassment, violence between partners, serving alcoholic beverages and anabolic substances, while presenting their criminological picture. The work outlines the position of youth in the international documents and the Czech legal system. It also defines the essential elements of criminal law protection of youth in the Penal Code and specifically in the new Penal Code. The work also notes the most important criminal procedural relations in criminal activity committed on youth which include the position of a child as a victim in criminal proceedings, examination of a person under fifteen years of age and protection of privacy of a child within criminal proceedings. logic study was also performed with the objective to map the opinions and experience of older pupils of the second degree of elementary schools in the field of criminality committed on youth. At the conclusion the work summarizes the current knowledge of criminal activity committed on youth and its possible perspectives. The thesis has been drawn up as an analytical study. It offers an overview of criminality committed on youth and stands it to a variety of criminological and criminal law connections. It analyses theoretical issues which relate to criminality committed on youth and the protection of youth in the legal system, generalizes the experience with the Penal Code and critically assesses the new Penal Code. The work points out the application problems and tries to offer possibilities how to resolve them. For the purpose of an easier comprehension the issue is supported with dozens of real cases. It is the first work which thoroughly and systematically deals with the issue of criminal activity committed on youth in the Czech Republic. Some up-to-date criminological and criminal law knowledge in this field have been dealt with in this work for the first time ever.
