The right to safety and the state´s duty to defend its citizens in the Czech Republic and worldwide

Abstract:

V této diplomové práci se zabývám nejen funkcí státu v zajišťování bezpečnosti, velkou pozornost věnuji také oblasti lidských práv a svod, která jsou v souvislosti se zajišťováním bezpečnosti omezována nebo dokonce dochází k jejich hrubému porušování. Kromě případu, kdy může s obavou z terorismu docházet k omezování práv a svobod civilistů, zmiňuji i případy, kdy se státy a jejich orgány vědomě dopouštějí porušování práv teroristů. Upozorňuji zde na neoprávněnost alternativních praktik výslechu (mučení), kterým jsou tyto osoby podrobeny a na to, že takovéto postupy neodpovídají zásadám právního státu. V závěru této diplomové práce se rovněž zabývám tím, jak státy poskytují ochranou svým občanům na svém území i mimo jeho hranice. Uvádím zde i případy, kdy se Česká republika měla možnost v této oblasti projevit. Rovněž se zde vyjadřuji k problematice neoprávněného zadržování osob na území cizího státu, jejich převážení přes území dalších států, které o těchto přesunech věděly, avšak nijak nezakročily.

Abstract:

At the dissertation I am not focusing just on the function of the State to provide Security and the State?s cooperation in a scope of OSN. I also focus my attention on the area of human rights and freedoms, which are in accordance with the Security provision inhibited or they can be grossly violated. Except the case where the fear of terrorism can inhibit the human rights and freedoms of civilians I also mention cases where States are knowingly disobey the rights of terrorists. I point out to the illegitimacy of alternative practices of the interrogation (torture) to which are those people subjected as well as on the fact that this procedure does not respond to the principles of the rule of law. At the end of the dissertation I also focus on the way how States provide protection to their citizens on their territory or abroad. I give examples where Czech Republic has the opportunity to demonstrate itself in this concrete area. I also put forward the illegal detention of citizens on the territory of foreign state, their transportation through the other States, who were aware of those transports, but they didn?t intervene.
