Tax deductible and non-deductible expenses in the light od case law

Abstract:

Diplomová práce je zaměřena na problematiku esenciálních výdajů, jejich vymezení a podmínky pro jejich použití. Základem práce je vyjasnění podmínek pro uznání esenciálních výdajů, které jsou podloženy judikaturou Ústavního soudu a Nejvyššího správního soudu. Stanovením podmínek pro jejich přiznání je tak snahou o určení daně ve výši co nejvíce odpovídající skutečnosti. Cílem je posouzení uplatnění esenciálních výdajů s rámci stanovení daně podle pomůcek se stanovení daně primárním způsobem, tedy dokazováním. V závěru práce je stručné shrnutí této problematiky se závěrečným konstatováním, že rovnost daňových subjektů je nutno posuzovat jak po dokladové stránce plnění, tak stránce faktické, a to již při samotném uskutečnění daňového plnění. Přiznání esenciálních výdajů tak diskriminuje část daňových subjektů a narušuje rovnost práv a povinností, proto by mělo být omezeno jejich uplatňování jen na odůvodněné případy.

Abstract:

The thesis is focused on the issue of essential expenses, their definition and the conditions for their use. The basis of the work is a clarification of the conditions for recognition of essential expenses, which are supported by the judicature of the Constitutional Court and the Supreme Administrative Court. A specification of conditions for their recognition is thus an effort to determine the tax in the amount that corresponds as much as possible to the facts. The goal is to assess the application of essential expenses within the tax assessment according to the means of tax assessment in the primary way, i.e. by proofs. At the end of the thesis, there is a brief summary of this issue with the final statement that the equality of tax subjects must be assessed both on the documentary side of the performance and on the factual side, and that already during the actual implementation of the tax performance. The recognition of essential expenses thus discriminates against some tax subjects and affects the equality of rights and obligations, and therefore their application should be limited only to justified cases.
