Dealing with company bankruptcy, principles of insolvency proceedings, creditors and claims.

Abstract:

Cílem této bakalářské práce bylo zhodnocení dopadu insolvence na věřitele. Přínosy této práce spočívají v seznámení čtenáře s konkrétním případem insolvence společnosti „XXX“, která vedla až k jejímu úpadku. Na konkrétním případu jednoho z větších insolvenčních řízení, které doposud proběhlo na území České republiky, je specifikován vliv tohoto řízení na jednoho ze zúčastněných věřitelů. Teoretická část se zabývá úpadkem, jeho právní úpravou a způsoby, které řeší úpadek (konkurs, reorganizace a oddlužení). Poté je definováno insolvenční řízení, jeho zahájení, zásady a účinky spojené se zahájením insolvenčním řízení. Je zde definován nástroj, který slouží jako hlavní zdroj informací o celkové finanční a ekonomické situaci společnosti. Tím je finanční analýza, její metody a ukazatele. Část praktická je zaměřena na konkrétní insolvenční řízení. Jeho účastníky jsou tedy dlužník „XXX“ a věřitel „XYZ“. Tato část popisuje situaci v obou firmách z pohledu finanční analýzy, dále uvádí důvody vzniku insolvenčního řízení, specifikuje samotný průběh insolvenčního řízení a jeho výsledek a vliv na podnik „XYZ“. V závěru této práce jsou shrnuty základní informace a získané poznatky.

Abstract:

The aim of this bachelor's thesis was to assess the impact of insolvency on creditors. The benefits of this work lie in getting the reader acquainted with the specific insolvency case of "XXX" company, which led to its bankruptcy. The impact of this procedure on one of the participating creditors is specified in the specific case of one of the larger insolvency proceedings that has taken place in the Czech Republic so far. The theoretical part deals with bankruptcy, its legislation and ways of dealing with bankruptcy (bankruptcy, reorganization and debt relief). Then the insolvency proceedings, opening insolvency proceedings, principles and effects associated with the opening of insolvency proceedings are defined. There is defined a tool that serves as the main source of information on the overall financial and economic situation of the company. This tool is financial analysis, its methods and indicators. The practical part is focused on specific insolvency proceedings. Its participants are the debtor "XXX" and the creditor "XYZ". This section describes the situation in both companies from the point of view of financial analysis, further states the reasons for the insolvency proceedings, specifies the course of insolvency proceedings and their outcome and the impact on the company "XYZ". At the end of this work the basic information and gained knowledge are summarized.
