Right to obtain information as a part of freedom of speech

Abstract:

Předmětem této bakalářská práce je právo na informace jako součást svobody projevu. První čtyři kapitoly se zabývají vymezením práva na informace na mezinárodní i vnitrostátní úrovni. Zbylé části práce se pak věnují zákonu o svobodném přístupu k informacím, který je prováděcím předpisem práva na informace o činnosti veřejné správy v českém právním řádu. Zákon o svobodném přístupu k informacím je zde popsán jednoduchou a stručnou formou tak, aby podal návod, jak krok po kroku získat od orgánů veřejné správy požadovanou informaci. Přitom je k látce přistupováno z pohledu novináře jako případného žadatele o informaci. Celý text práce i analýza zákona jsou proto směřovány k novinářské činnosti. Aplikace tohoto zákona v souvislosti s novináři je zobrazena na soudních rozhodnutích, nejčastěji Nevyššího správního soudu a Ústavního soudu. Na těchto rozhodnutích jsem následně popsal, jakým způsobem soudy na problematiku práva na informace nahlížejí a v čí prospěch v převážné míře rozhodují. Dospěl jsem k závěru, že soudy se ve svých rozhodnutích snaží právo na informace chránit v co nejširší možné míře a novináři tak mají v zákoně o svobodném přístupu k informacím dostatečnou oporu pro vykonávání svojí práce.

Abstract:

The main objective of this bachelor’s thesis is the right to obtain information as a part of freedom of speech. The first four chapters deal with a classification of the right to gain information at the international and intranational level. The rest of the work is concerned with a law about free access to information, which is a controlling regulation of law to gain information about activity of public administrative in the Czech System of Law. The law about free access to information is being described in a simple and clear manner, so that it can provide a manual how to get to the requested information from the authorities step by step. Nevertheless, the whole material is being approached from the journalist’s point of view, who is incidentally asking for information. The whole text of this work is, along with the analysis of the law, aimed at the journalist’s work. Application of this law in connection with journalists is shown in adjudications, mostly made by the Supreme Administration Court and Constitutional Court. Concerning these adjudications, I described the way courts regard with a right to obtain information and I also described in whose favour these courts usually decide. My conclusion is, that the courts highly protect the right to obtain information in their adjudications, which gives a good backing for the journalists to do their job.
